This Part shall be known as the "Garage Sale Ordinance of the
Borough of Honey Brook."

As used in this Part, the following terms shall have the meanings
indicated:
GARAGE SALE OR SALES
Any sale of household or personal property conducted from
a residence or from a premises not regularly used as a commercial
retail outlet, and advertised as a garage sale, attic sale, yard sale,
barn sale, porch sale, or similar designation, and having as its primary
purpose the sale and delivery and disposition of used household furnishings
or personal property.

It shall be unlawful to advertise or conduct any garage sale,
as defined above, in the Borough of Honey Brook unless a permit shall
first have been obtained from the Borough Clerk, or other authorized
Borough office staff member, and proper permit fees are paid in full
to the Borough.

A fee for the issuance of a permit for a garage sale or sales
shall be established by the Council of the Borough of Honey Brook
changed from time to time by resolution of the Council.

Garage sales shall be permitted in the Borough no more than
four times per year at any one premises.

The vendor who organizes a garage sale or the owner of the premises
upon which sale is held, shall have a duty to provide adequate parking
facilities for all anticipated customers and shall see to it that
no traveled portion of any public highway is any way blocked, partially
or otherwise, or that the flow of traffic is impeded thereon in any
way.

Garage sales may be held only on Monday through Saturday from
7:00 a.m. to 9:00 p.m. and no garage sales shall be held on Sundays.

A garage sale shall not under any circumstances extend for more
than two consecutive days.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof, shall be sentenced to pay a
fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30
days. Each day that a violation of this Part continues shall constitute
a separate offense.
