The Borough Council of the Borough of Darby, pursuant to the authority vested in it by applicable law, as may be amended from time to time, finds and declares the necessity of a Recreation Board operating within the territorial limits of the Borough of Darby and hereby authorizes, creates and establishes the "Borough of Darby Recreation Board."
A. 
The purpose of the Board is to oversee capital improvement projects of Borough-owned recreational facilities, manage and operate Borough-owned recreational facilities except those for which Borough Council has or may reserve unto itself; to obtain financing for capital improvement projects and other operational costs; and, to obtain grants to develop a comprehensive recreation plan for the Borough and its residents.
B. 
The Board shall promote and engage in activities that enhance the use and enjoyment of recreation in the Borough and Borough-owned recreational facilities.
C. 
The Board may exercise all powers provided it by the laws of the Commonwealth of Pennsylvania and the ordinances and resolutions of the Borough of Darby.
D. 
The Board shall report monthly to the Borough Council's Recreation Committee.
A. 
The Council of the Borough of Darby shall appoint the members of said Board.
B. 
The Board shall consist of nine members, two of whom may be School Directors of the William Penn School District.
C. 
All members of the Board shall be residents of the Borough of Darby.
D. 
The terms of the first members shall be so fixed that no more than two members shall be replaced or reappointed during any one calendar year. Their successors shall serve for a term of five years.
E. 
The position of any member of the Board appointed in his/her capacity as a School Director of the William Penn School District automatically ceases upon that person's leaving the office of School Director, and that position shall be considered vacant, with Council to fill the vacancy in accordance with the terms hereof.
F. 
An appointment to fill a vacancy in the Board shall be only for the unexpired portion of the term.
G. 
The Board shall elect its own Chairman and Secretary, and may select, in such manner as it determines, other necessary officers. The offices of Chairman, Secretary, and any other offices, shall have a term of one year, and the Board shall reorganize annually.
H. 
The Board shall have power to adopt such rules, regulations and bylaws for the conduct of all business within their jurisdiction as shall be consistent with the laws of the Commonwealth of Pennsylvania and the ordinances and resolutions of the Borough of Darby.
A. 
The laws of the Commonwealth of Pennsylvania and ordinances of the Borough of Darby shall govern the Board and all of its actions.
B. 
All ordinances or parts thereof that are inconsistent herewith are repealed.
C. 
The Board shall have power to adopt such rules, regulations and bylaws for the conduct of all business within its jurisdiction as shall be consistent with the laws of the Commonwealth of Pennsylvania and the ordinances and resolutions of the Borough of Darby.
