Continued reports have been submitted to the members of Council of the Borough of Darby concerning the suffocation of children who have become locked in old abandoned refrigerators, iceboxes, ice chests or other similar containers.
The said Council of the Borough of Darby does hereby declare that the abandonment of old refrigerators, iceboxes, ice chests or other similar containers with the door latches or doors still attached thereto is highly dangerous and a public menace.
It shall be unlawful for any person, firm or corporation to permit or allow any person, firm or corporation to discard or abandon, or for themselves to discard or abandon, within the limits of the Borough of Darby, any old refrigerator, iceboxes, ice chest or other similar container which may still have its door affixed thereof which, by any means, may accidentally or deliberately imprison any person, particularly children.
It shall be unlawful for any person, firm or corporation to leave outside any building or dwelling, in a place accessible to children, any abandoned, unattended or discarded refrigerators, iceboxes, ice chests or other similar containers which have an airtight or other device thereon without first removing the doors from the said refrigerator, icebox, ice chest or other similar container.

Any person who shall violate any provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $300 and costs of such proceedings or, upon default of payment of such fines and costs, by imprisonment in the county jail for a term of not more than 30 days. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided above for each separate offense.
