N.J.S.A. 39:4-139.13a provides that "the governing body of every
municipality may make, amend, repeal and enforce an ordinance authorizing
the impoundment or immobilization of a vehicle found within the jurisdiction
of that municipality if there are any outstanding warrants against
the vehicle."
Based upon the power given to Hackensack under this statute, the
City bans the immobilization of vehicles, also known as "booting,"
by a private individual or entity for any reason whatsoever.
Violators of this article shall receive a fine of no less than $100
and no more than $500 for the first offense. The penalty for a second
and subsequent offenses shall be no less than $500 and no more than
$2,500.
