The Board of Fire Commissioners is hereby abolished effective upon the appointment of a Fire Director or December 31, 2008, whichever event occurs first in time. The powers and duties of the Board of Fire Commissioners shall be subsumed by the municipality as set forth in the Charter, applicable statutes and this article. The Mayor shall serve as the appointing authority for all fire personnel and the legislative authority shall vest in the City Council.
Subject to the provisions of Chapter 25 of this Code, and under the authority, direction and supervision of the Department of Public Safety, there shall be a Division of Fire, the head of which shall be the Fire Chief.
The Fire Chief shall have control and general supervision and direction of the Division of Fire for the fighting and extinguishment of fires and the safeguarding of the citizens and property of the City of East Orange against destruction by fire. The Fire Chief shall be directly responsible to the Public Safety Director for the efficiency and day-to-day operations of the Division of Fire.
Under direction and supervision of the Public Safety Director, the Division of Fire shall:
A. 
Have exclusive jurisdiction over the control, fighting and extinguishing of any conflagration which occurs within the City limits.
B. 
Provide the firefighting services and facilities for the protection of life and property within the City and in accordance with such mutual aid agreements as may be enforced.
C. 
Investigate the cause, circumstances and origin of fires and report to the County Prosecutor every case of suspicious arson.
D. 
Maintain and administer fire prevention and fire safety inspection service for the City.
