A. 
Open burning defined.
OPEN BURNING
Any fire or combustion from which air contaminants pass directly into the open air without passing through a flue. The term includes any fire or combustion which occurs in a chiminea, fire pit, outdoor fireplace or grill.
B. 
No person shall conduct, or allow to be conducted, any open burning except where the open burning is conducted solely for the purpose of noncommercial preparation of food for human consumption, recreation, light, ornament, or to provide warmth for outside workers. The manner of burning shall contribute a negligible amount of air contaminants as defined herein.
No material other than clean wood, propane, or natural gas may be open-burned except for:
A. 
Commercially available fire logs, paraffin logs, or wood pellets.
B. 
Paper or commercial smokeless fire starters in order to start a fire.
C. 
Charcoal for the preparation of food only.
A. 
Fires must be at least 15 feet from the nearest neighbor's dwelling or inhabited area, including:
(1) 
Property line.
(2) 
Roadway.
(3) 
Sidewalk.
(4) 
Public access area.
B. 
Fires may be no larger than three feet wide by three feet long by two feet high.
As defined by Allegheny County, air quality action days occur when the Air Quality Index (AQI), a measurement of pollution levels in the region, is at the "orange" or "unhealthy" level. Alerts are provided by Allegheny County via www.alleghenycounty.us/alerts. Woodburning activities are prohibited on air quality action days, with the exception of burning for the commercial preparation of food.
Burning may be prohibited or reduced if it is considered a nuisance, based on the following criteria:
A. 
The severity of the amount of air pollutants.
B. 
The duration or frequency of open burning.
C. 
The topography of the surroundings.
D. 
The meteorological conditions.
Permits are required to be received from Allegheny County with regard to open burning in the Borough of Port Vue relating to:
A. 
The abatement of a fire or public health hazard when the burning is conducted under the supervision of a public officer;
B. 
The instruction of personnel in firefighting, except that instruction using only propane does not require a permit;
C. 
The fostering of agriculture;
D. 
The conducting of a ceremony; or
E. 
Clearing and grubbing waste subject to Allegheny County's regulations.
Any person who violates any provision of this article shall, upon conviction, be guilty of a misdemeanor, which is punishable by a fine of not less than $300 nor more than $1,000 or, in default of payment of such fine, by imprisonment for a period of not more than 30 days, or both. Each day of violation shall be considered a separate and distinct offense.
