As used in this article, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
CARTWAY
Portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder.
CURB
The edge where a raised sidewalk, pavement, or road median meets a street, highway, cartway or other roadway.
MATERIALS
All solid or liquid waste material resulting from construction, building operations, demolition, or the performance of any business, trade, industry or personal use, including, but not limited to, asphalt shingles, electric wiring, plastic products, cartons, containers, cinders, processed wood, stones, dirt, mulch and other forms of solid and liquid materials.
SIDEWALK
A level, concrete area, used as a pedestrian walkway, which parallels but is separate from the cartway of a street.
STREET or HIGHWAY
The entire width between the boundary lines of a way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
WASTE
Material discarded as worthless or of no use.
YARD WASTE
Waste resulting from the normal maintenance and upkeep of a yard or farm, including, but not limited to, limbs, branches, bushes, garden plants, etc.
A. 
Unless otherwise approved in writing by the Township, no person(s) shall at any time commit the following upon any cartway, sidewalk, street, highway or curb within Upper Uwchlan Township:
(1) 
Deposit or pile any material or waste.
(2) 
Operate any non-rubber tracked or non-rubber wheeled equipment or vehicle without first placing a protective surface down on the roadway to travel upon.
(3) 
Permit any construction, building, demolition or other equipment to remain after dark. All equipment must be properly marked to alert motorists and pedestrians with traffic control devices in accordance with the Manual on Uniform Traffic Control Devices.
(4) 
Allow the placement of any dumpster or other form of container.
(5) 
Allow any vehicle or construction equipment to have contact with or travel upon any curb without first placing a protective surface down to prevent damage.
Any person who violates or permits a violation of this article shall, upon conviction in a summary proceeding brought before a Magisterial District Judge under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary offense and shall be punishable by a fine of not more than $300, plus costs of prosecution. In default of payment thereof, the defendant may be sentenced to imprisonment for a term not exceeding 90 days. Each day or portion thereof that such violation continues or is permitted to continue shall constitute a separate offense, and each section of this article that is violated shall also constitute a separate offense. In addition to the fine, the Township may seek to recover from the defendant all of the costs it incurs to abate the violation of this article.
