Part 1 Hartzell/Gristmill Area Neighborhood Improvement District

The Township Board of Supervisors does hereby approve the NID Plan, attached as Exhibit A hereto, and designates the area or areas identified in the NID Plan as an NID. The name of the NID is "Hartzell/Gristmill Area Neighborhood Improvement District."

The Township Board of Supervisors does hereby designate the Jackson Township Community Development Corporation as the Neighborhood Improvement District Management Association (the "NIDMA") to administer programs, improvements and services within the NID in accordance with the Neighborhood Improvement District Act.

The Township Board of Supervisors, pursuant to Section 7 of the Act, does hereby authorize the imposition of special assessments on real property located within the NID in accordance with the rate and method of apportionment of special assessments set forth in the NID Plan, such rate and method of apportionment of special assessments being in compliance with Section 7 of the Act, and such rate and method of apportionment of special assessments is hereby approved. The special assessments will provide for the payment of debt service incurred by the NIDMA to finance waterline installation within the NID, all as provided for within the NID Plan. The debt service shall be in the form and substance satisfactory to the Township and its Solicitor.

The Township Board of Supervisors is hereby authorized to take any further action necessary or appropriate to carry out the intent of this Part 1, including but not limited to the execution of an agreement with the NIDMA as required by the Act and as provided for within the NID Plan, and the Chairman of the Township Board of Supervisors and the Township Secretary are hereby authorized to execute such agreement as well as any other agreements consistent with the Act and NID Plan that the Township will need to enter into in furtherance of this Part 1.
