Borough of Spring Grove, PA Snow and Ice Emergencies

Whenever the Borough has received from a recognized weather forecasting service a firm forecast of an anticipated accumulation of snow, sleet or freezing rain.

Whenever there exists upon the streets and sidewalks within the Borough a substantial accumulation of snow which, for the effective removal thereof, requires prohibition of parking.

§ 375-35 Announcements of emergencies.

The announcements required to be made by this Part 2 shall be made between the hours of 6:00 a.m. and 11:00 p.m. by means of broadcasts, telecasts or otherwise with a normal operation range covering the Borough.

§ 375-36 Regulations for snow emergencies.

The Mayor of the Borough (and in his absence, the President of Council) shall be authorized to declare a snow emergency whenever snow and ice emergencies exist. Said declaration shall state the time after which snow and ice emergency regulations shall be in effect.

Such declaration and the announcement thereof shall be made not less than two hours prior to the time the snow emergency is to go into effect.

On each street designated as a primary snow emergency route, signs shall be erected so stating, SNOW EMERGENCY ROUTE, prohibiting the parking of vehicles during a declared snow emergency.

While a snow emergency is in effect and until such emergency has been terminated, no person shall operate a motor vehicle on any snow emergency route in such manner or in such condition as to allow or permit such vehicle to become stalled on such route, either by reason of the fact that the driving wheels of such vehicle are not equipped with tire chains or effective snow tires or by reason of the fact that the motor fuel supply of such vehicle has been allowed to become exhausted, or otherwise abandoned.

Parking shall be prohibited on any primary snow emergency route two hours after the effective time of any snow emergency. Such parking prohibition shall continue until announcement has been made of the termination of the snow emergency either in whole or in part.

Where a snow emergency has not been declared and announced by 11:00 p.m., the parking prohibition set forth in Subsection F hereof shall not apply until 8:00 a.m. the following day.

Whenever the Mayor of the Borough (and in his absence, the President of Council) shall find that some or all of the conditions which gave rise to the snow emergency no longer exist, he is authorized to declare a termination of the emergency, in whole or in part, effective immediately upon announcement. The Mayor or, in the absence of the Mayor, the President of Council shall have the authority to, at the time of the announcement of the snow emergency, also announce the length of duration of the snow emergency, in place of or in addition to any announcement authorized by this subsection.

The Borough Council shall from time to time designate private parking lots in the Borough which shall be available for parking of vehicles during times of declared snow emergencies. Property owners along designated snow emergency routes shall be notified prior to the announcement of a snow emergency of the location of said lots. Borough residents shall be permitted to park on said designated lots, without penalty, for the duration of the announced snow emergency. All vehicles so parked shall be removed from said designated parking areas no later than 24 hours after the announced termination of the snow emergency, as announced pursuant to Subsection H of this section. In the event that a vehicle which was parked on a designated parking lot, and which would not otherwise be authorized to remain there, is not removed within 24 hours after the termination of the snow emergency, the Borough shall be authorized to tow or cause to be towed such vehicle from the designated parking lot to a location to be determined by the Borough. In the event that a vehicle is towed pursuant to this subsection, then, in addition to any other penalties set forth in this article of this chapter, all of the provisions of § 375-39A and B shall apply to this subsection.

§ 375-37 Snow removal regulations.

The Mayor of the Borough (and in his absence, the President of Council) shall be authorized to declare a temporary ban on parking on any street within the Borough whenever snow removal conditions exist. Said declaration shall state the time after which parking shall be prohibited on any street.

Such declaration and the announcement thereof shall be made not less than four hours prior to the time the snow removal is to begin on any specified street.

Temporary signs prohibiting parking on such streets shall be posted not less than four hours prior to the time the snow removal is to begin.[1]

Former Subsections E and F, dealing with the removal of snow from sidewalks and the deposit of snow in streets, which immediately followed Subsection D, were repealed 6-6-1994 by Ord. No. 2-1994.

§ 375-38 Saving of parking spaces.

It shall be a violation of this article to save a parking space within the cartway of any Borough street or alley in any manner whatsoever, including but not limited to the placement of chairs, tables or other articles designed or intended to save or reserve parking spaces during times of snow or inclement weather. Borough employees shall have the authority to remove any such object which, in the sole discretion of the Borough employees, is being used for or has the effect of saving or reserving any parking space within the Borough cartway.

§ 375-39 Violations and penalties.

Any person, partnership, business, corporation or other entity violating the provisions of this article, upon the issuance of a citation and conviction by a Magisterial District Judge, shall be guilty of a summary offense and shall pay a fine of not less than $50 nor more than $300. Each day a violation exists shall be considered a separate violation, subject to the same fines as set forth herein. It shall not be necessary to issue a separate citation for each day, but one citation can be issued to cover multiple days of violations. The Borough hereby authorizes the Borough Manager, Secretary or Codes Enforcement Officer or any duly authorized and constituted police officer to issue citations for violations of this article.

In the event that a motor vehicle is parked on a primary snow emergency route in violation of this article, the enforcement officer as designated in Subsection A shall remove or cause the removal of such motor vehicle to a place designated by the Borough. Prior to the owner of such motor vehicle regaining possession of said vehicle or upon assessment of a penalty pursuant to Subsection A, the owner shall pay to the Borough the costs incurred by the Borough in causing such removal and storage, which shall be in addition to any penalties assessed pursuant to Subsection A. In the event that the owner of said vehicle fails or refuses to reclaim such vehicle, then the Borough shall, in addition to all other rights granted herein and by law, be entitled to pursue a civil action against said owner for the cost of the towing and storage of said vehicle. Neither the Borough, its employees or contractors shall have any liability for any damage to any motor vehicle parked in violation of this article, occurring to such motor vehicle by reason of the Borough's removal of such vehicle from its parking location, and/or by reason of the Borough's road maintenance and/or snow removal activities or operations.
