The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
CHICK
A fowl of unknown sex up to the age of two weeks.
COOP
A free-standing building for the sheltering of domestic fowl.
DOMESTICATED ANIMALS
Any domestic mammal or domestic fowl, except domestic cats or dogs.
DOMESTICATED FOWL
Any of a variety of female domesticated chicken, pigeon, or quail species, not to include other birds or the males of any species.
DOMESTICATED MAMMALS
Any of a variety of domesticated rabbits, horses, mules, asses, cows, goats, sheep and miniature potbellied pigs, not to include any other unnamed mammals.
ENCLOSURE
A fence or sturdy wire pen containing a coop for the purpose of allowing fowl access to the coop while remaining in an enclosed pen.
HEN
An adult female chicken.
MANURE
Material consisting of "domesticated animal" dung as defined within this section consisting often with discarded animal bedding.
SINGLE-FAMILY RESIDENTIAL LOT
A single parcel or a contiguous parcel of land under the same ownership, in a primarily residential zone that is occupied by one single-family detached home.
SLAUGHTER
The killing and processing of animals and poultry for use as food or feed.

Any person keeping domesticated animals shall remain subject to public nuisance controls codified in Chapter 34 environment, Article III, nuisances of this Code.

All places where any domesticated animal is kept shall at all times be subject to inspection for cleanliness, health and sanitation purposes by a City police officer, City zoning/building official, county animal control officer or representative of the county health department and/or his/her designee. Said officers, officials and representatives are authorized to enter upon any premises, public or private, where a permit has been issued, for the purpose of making inspections to determine if the provisions of this article are being violated.

If, upon inspection, it is found that the provisions of this article have not been or are not being complied with, the City shall:
(a) 
Give written notice of the non-compliance to the owner, possessor or custodian of such domestic fowl; and such owner, possessor or custodian shall, within the 10 days after the receipt of such notice, proceed to fully comply with the provisions of this article and is subject to an inspection for compliance and any inspections fees that may be set by the City Council.
(b) 
If the notice of non-compliance is not complied with and or any inspection fees are not paid within the 10 days allowed, a notice of permit revocation shall be issued and such owner, custodian, shall be subject to any and all penalties and fees under the provisions of this chapter.
(c) 
The issuance of three or more notices of non-compliance pertaining to this chapter within any twelve-month period to any owner, possessor or custodian of domesticated animals, shall be grounds for revocation of a permit to keep domesticated animals.
(d) 
A new permit shall not be issued to any person who has had a permit revoked until the passage of one year after such revocation and only after payment of all fees for previous violations and inspections(s) have been paid.
(e) 
Interference with an enforcement officer, officials or City representatives and/or his/her designee in performance of his duties with regard to this chapter shall be a violation.

Violations of this chapter may result in the revocation of the permit allowing the keeping of domesticated animals, and shall constitute a misdemeanor punishable as hereafter set forth.

Any person violating this chapter, shall be subject to punishment as provided in § 1-14 of this Code.
