[HISTORY: Adopted by the Mayor and Council of the Borough of Penns Grove as Ch. 20 of the 1968 Revised Ordinances (Ch. 59 of the 1986 Code). Amendments noted where applicable.]
There is hereby created and established in and for the Borough of Penns Grove, Salem County, New Jersey, a public body corporate and politic under the name and style of the "Penns Grove Sewerage Authority" pursuant to the provisions of the Sewerage Authorities Law of the State of New Jersey, being N.J.S.A. 40:14A-1 et seq.
The Penns Grove Sewerage Authority, hereby created, shall have and exercise all of the powers and rights and perform all of the duties of a sewerage authority as defined in said Sewerage Authorities Law and in any and all statutes heretofore or hereafter enacted supplementing, amending or revising said Sewerage Authorities Law.
A copy of this chapter, duly certified by the Borough Clerk, shall be filed by said Borough Clerk in the office of the Secretary of State of the State of New Jersey forthwith upon final passage hereof.[1]

The Borough of Penns Grove in the County of Salem, New Jersey, does hereby determine that it will be economical and otherwise advantageous to it, to the Penns Grove Sewerage Authority and to the residents and property owners of the Borough for the Borough and said Authority to enter into a contract providing for and relating to the treatment and disposal of sewage and other wastes originating in the Borough by means of a sanitary sewerage system acquired or constructed by said Authority and the cost and expense of such treatment and disposal; which contract, among other things, shall obligate said Authority to continue with the operation and development of said sewerage system and obligate the Borough to pay to said Authority such sum or sums of money as may be necessary to provide for deficits which might result if said Authority failed to receive the revenues expected to be derived from the operation of its properties, all substantially on the terms of the contract authorized by this chapter.
The Borough of Penns Grove in the County of Salem, New Jersey, shall enter into a contract with the Penns Grove Sewerage Authority providing for and relating to the treatment and disposal of sewage and other wastes and the cost and expense of such treatment and disposal, and the Mayor shall be and he hereby is authorized and directed on behalf of the Borough to execute said contract under the corporate Seal of the Borough, which shall be affixed and attested by the Borough Clerk, and to deliver the same.
