The Borough of Milton currently has three primary parking lots
which are utilized by the public, Borough employees, and officials.
The Borough Council has determined to enact the following regulations
regarding the use and activities permitted within these lots and other
properties owned by the Borough in which parking areas are available.
The following municipal parking lots are established:
A.
Parking Lot No. 1: A municipal parking lot located in the Milton
commercial business district and bordered on the west by Elm Street;
the north by Cherry Alley; the east by Bound Avenue and the south
by Center Street.
B.
Parking Lot No. 2: A municipal parking lot located south of the Police
Station and beginning at the electric pole located at the northwest
corner of the parking lot, heading in a southerly direction a distance
of 108 feet to an electric pole located at the southwest corner of
the parking lot, from there heading in an easterly direction a distance
of 80 feet to the southeast corner of the parking lot, then heading
in a northerly direction a distance of 108 feet to the northeast corner
of the parking lot, then heading in a westerly direction a distance
of 80 feet to the electric pole located at the northwest corner of
the parking lot.
C.
Parking Lot No. 3: A municipal parking lot located south of the Borough
Hall and beginning at the northeast corner of the intersection of
the first alley south of the Borough Hall and Filbert Street, then
heading in a westerly direction a distance of eight feet to the southeast
corner of the public lot, then heading in a northerly direction along
Filbert Street a distance of 20 feet to the northeast corner of the
parking lot, then heading in a westerly direction a distance 87 feet
to the northwest corner of the parking lot, then heading in a southerly
direction a distance of 20 feet to the southwest corner of the parking
lot, then heading in an easterly direction along said alley a distance
of 87 feet to the southeast corner of the parking lot.
With the exception of official Borough or authorized Borough
employee vehicles, no vehicles shall be parked in Parking Lot No.
1, No. 2 and/or No. 3 between the hours of 2:00 a.m. and 5:00 a.m.,
unless a permit is issued for the vehicle to be located in the respective
parking lot during those hours.
It shall be at the discretion of the Milton Borough Council to determine whether all or any portion of Parking Lot No. 1, 2, or 3, shall have parking meters installed. Such determination may be made by Milton Borough Council and established by adoption of a resolution making that designation. Meter rates shall be established from time to time by Council and adopted in the form of a resolution. A vehicle parked in a metered space at which the metered time has expired will be in violation of this article, and vehicles parked in a metered parking lot shall be in violation of this article if they are not in compliance with the requirements of Borough Ordinance Article VII, Metered Parking (§§ 233-37 to 233-45), of the Code of Ordinances of the Borough of Milton, and will be subject to the enforcement and violation penalties of this article.
No individuals shall sit or stand in the areas of the parking
lot designated for vehicular traffic and parking and/or participate
in any activity which would hinder or obstruct the safe ingress or
egress or movement of vehicles within the parking lot, or pose a danger
to the personal safety of those participating or those utilizing the
parking lot for parking, unless such activity is in conjunction with
an event or activity approved by the Milton Borough Council.
A.
Parking Lot No. 1. Lines and/or markings may be placed upon the surface
of the parking lot, for the purpose of delineating each parking space.
Every vehicle is required to be parked in such a manner as to be wholly
within the lines or markings so placed and applicable to that space.
B.
Parking Lots Nos. 2 and 3. In the event that Parking Lots Nos. 2
and 3 remain unpaved and unlined, parking areas will be established
as determined by the Borough Manager, and appropriate signage will
be placed in the parking lot to indicate where and how vehicles are
to be parked.
C.
Unauthorized parking areas. With the exception of authorized Borough
or Borough employee-owned vehicles, all parking is prohibited on any
other properties owned by the Borough in which parking areas are available
unless expressly permitted by signage.
D.
Restricted parking by order of Borough Council, the Borough Manager,
the Milton Police Department, or the Mayor. Borough Council, the Borough
Manager, the Milton Police Department, or the Mayor, may, at their
discretion, restrict parking in the municipal parking lots for the
purposes of facilitating special events or activities approved by
the Borough Council, or emergency or other situations.
E.
Violation. Vehicles not parked in compliance with this section will
be in violation of this article and subject to the penalties as stated
within and may be towed at the vehicle owner's expense.
A.
In compliance with state or federal regulations, the Borough Council
will provide by resolution, at convenient and suitable locations in
any one or more of the metered or unmetered parking lots, reserved
parking spaces designated for handicapped parking, and shall designate
those spaces by appropriate signage.
B.
It shall be unlawful and a violation of this article for any person
to park in any such reserved parking space any vehicle unless that
vehicles bears or displays either a "handicapped registration plate,"
a "handicapped parking placard," a "disabled veteran registration
plate," or " a disabled veteran placard."

A.
In Parking Lot No. 1, there are several designated spaces that are
reserved for the employees of M&T Bank which have been set aside
due to M&T Bank's conveyance of certain land to the Borough to
accomplish renovation of the parking lot. Those spaces are reserved
strictly for M&T Bank employees and customers at no cost or charge
to M&T Bank. All other persons are prohibited from parking in
those spaces that are so designated.
B.
In Parking Lot No. 1, the first four spaces at the northwestern corner
of Parking Lot No. 1 are reserved for employees of the District Justice
Office No. 08-3-02 during the hours of 8:00 a.m. to 5:00 p.m. on Monday
through Friday of each and every week at no cost or charge to the
owners of the office and any lessee thereof who leases the space.
The spaces may be used for general parking as provided in this chapter
at times other than those specifically specified above. All other
persons are prohibited from parking in those spaces during the days
and hours that are so designated.
C.
Vehicles that are not parked in compliance with this section will
be in violation of this chapter and subject to the penalties stated
within. Prior adopted ordinances establishing any other reserved parking
spaces within the Borough-owned parking lots are hereby repealed.
A.
Establishment of parking permit program. Establishment: There is hereby established a parking permit program for Municipal Parking Lot No. 1, Municipal Parking Lot No. 2, and Municipal Parking Lot No. 3. The permit is for use only in any of the parking spaces in the aforesaid parking lots and guarantees to the holder that they will have a parking space during the hours specified in § 233-70, but not a particular parking space in the said lot.
B.
Parking permit application; fees; issuance.
(1)
Application for a parking permit shall be made to the Milton Police
Department, by the person desiring the permit. The applicant shall
be a registered owner or licensed driver of the motor vehicle to be
permitted. Each application shall contain the following information:
the name, address and telephone number of the applicant; the make,
model, VIN, and license plate number of the motor vehicle to which
the permit shall apply. The applicant shall be required, at the time
of making application, to present a current driver's license, vehicle
registration card, and valid vehicle insurance card. Vehicles must
have a current vehicle inspection sticker and registration sticker
and license plate appropriately displayed on the vehicle.
(2)
Each application shall be accompanied by a permit fee, as established
from time to time by resolution of Borough Council. Permit fees shall
be payable in advance. Permit fee revenues shall be for the use of
the Borough to defer the cost of administering the parking permit
program.
(3)
The maximum number of applications available for each municipal parking
lot shall be established by resolution of the Borough Council.
(4)
Issuance of permit. Upon receipt of the application and the applicable
permit fee, and after determination by the Police Chief of the Milton
Police Department, or designee, that the information contained in
the application shows that the applicant has fulfilled the requirements
for a parking permit, the Police Chief of the Milton Police Department,
or designee, shall issue to the applicant a parking permit valid for
a period not to exceed 12 months. The permit shall display an assigned
permit number and or such other information as required by the Police
Chief of the Milton Police Department or his designee, and also display
the expiration date of the permit or in the alternative, a color code
or other code for the expiration date.
(5)
Display of permit. The parking permit must be visibly displayed on
the dash of the vehicle whenever it is parked in the designated municipal
parking lot during the time period for which it is required.
(6)
Permit renewal. The permit shall be renewable monthly, quarterly,
semiannually, or annually or for such period of time as shall be determined
from time to time by resolution of Borough Council. Renewal must be
complete prior to the expiration date. The person renewing a parking
permit must provide the same information required for the issuance
of the original permit.
(7)
Parking permits are nontransferrable. The permit is only valid for
the vehicle to which it was originally issued. Should the ownership
of the vehicle change, the permit shall become invalid.
(8)
Revocation of permits. The Chief of Police of the Milton Police Department
or designee shall have the authority to revoke a parking permit if
the person to whom the parking permit is issued is found to be in
violation of any provision of this article. Upon written notification
of such revocation, the permit holder shall surrender the permit to
the Police Chief of the Milton Police Department or designee. Failure
to surrender the revoked parking permit shall constitute a violation
of this article.
(9)
Appeal to Borough Council. Any person receiving notification of a
revoked parking permit may, within 10 days of receipt of the notification,
request a hearing before Borough Council to appeal the decision to
revoke the parking permit. The decision of Borough Council shall be
final.
A.
Enforcement authority and action.
(1)
It shall be the duty of the Milton Police Department and parking
enforcement personnel of the Borough to issue parking violation tickets
for violations of this article in accordance with the Pennsylvania
Rules of Criminal Procedure and Borough ordinances.
(2)
Violation tickets shall include the date and hour of the violation,
the license number of the vehicle involved in the violation, the location
where the violation occurred, and other facts relevant and necessary
for a thorough understanding of the circumstances attending the violation
and to substantiate any subsequent additional legal enforcement attending
the violation. The notice shall also include a statement that the
vehicle was parked in violation of this article and instructing the
owner of the vehicle that if the sum specified by resolution of Borough
Council is enclosed in the envelope provided and delivered to the
Milton Police Department within 10 days after the date of the notice,
that payment will prevent additional penalties and/or prosecution
with regard to this violation.
(3)
In the absence of a vehicle owner or operator being available for
service of the ticket, the parking enforcement personnel or police
officer shall attach the violation notice upon the vehicle.
(4)
Failure to pay the stated violation penalty within 10 days of the
issuance of the ticket will result in the issuance of a citation in
accordance with applicable rules of criminal procedure and Borough
ordinances. All violation fines and penalties shall be in accordance
with the Violation Penalties Ordinance of the Borough of Milton,[1] with all violation penalties being assessed as a Level
One Second Violation. In the case of multiple violations, each separate
violation will incur an additional penalty at the same level.
B.
Additional violations.
(1)
It shall constitute a violation of this article for any person to
display a falsified or altered parking permit at any time in a vehicle
parked in a municipal parking lot.
(2)
It shall constitute a violation of this article for any person to
falsely represent himself or herself as eligible for a parking permit
or to furnish false information in an application to the Police Chief
of the Milton Police Department or designee in order to obtain a parking
permit.
C.
Removal of vehicles in violation. In accordance with applicable state
law and Borough Ordinances, vehicles parked in violation of this article
may be removed by towing, the cost of which shall be the responsibility
of the vehicle owner. Nothing in this section shall preclude the ticketing
of unlawfully parked vehicles as provided in this article or the penalizing
of the owner thereof as provided in this article.
