A.
The Borough Council may direct the Public Officer to identify abandoned
property for the purpose of establishing an abandoned property list
throughout the Borough, or within those parts of the Borough as the
Council may designate. Each item of abandoned property as identified
shall include the tax block and lot number, the name of the owner
of record, if known, and the street address of the lot.
The criteria to be used to deem properties as being abandoned
shall be as set forth in the Abandoned Properties Rehabilitation Act
of the State of New Jersey, including specifically as set forth in
N.J.S.A. 55:19-81 and 55:19-82. Any and all legal rights of the Borough
and interested parties shall be in accordance with said Act.
The abandoned list shall be created and maintained in accordance
with N.J.S.A. 55:19-55, 55:19-57, 55:19-103 and other applicable authority.
A.
The Council may, at its option, require that the sale of a tax sale
certificate or any subsequent assignment in transfer of a tax sale
certificate held by the Borough related to an abandoned property be
subject to the express condition that the purchaser or assignee shall
be obligated to perform and conclude rehabilitation or repairs necessary
to remove the property from the abandoned property list in accordance
with N.J.S.A. 55:19-56.
B.
A purchaser of a tax sale certificate for a property on the abandoned
property list may institute a foreclosure action at any time after
the expiration of six months in accordance with N.J.S.A. 55:19-58.
C.
The Council may authorize the institution of a summary action in
the Superior Court to obtain possession, control, or title of abandoned
property in need of rehabilitation in accordance with N.J.S.A. 55:19-84
through 55:19-99.
D.
The Council may authorize special tax sales in accordance with N.J.S.A.
55:19-101.
E.
The Council may authorize eminent domain of abandoned property in
accordance with N.J.S.A. 55:19-102.
