A. 
The City Attorney shall be appointed by the Mayor, by and with the advice and consent of the Board of Aldermen. The City Attorney shall be licensed to practice law in the State of Missouri and shall be a member in good standing with the Missouri Bar Association. The City Attorney shall possess such other qualifications as may be required of other appointed officers. The term of appointment shall be for one (1) year and until a successor is appointed and qualified.
B. 
The duties of the City Attorney shall be to:
1. 
Prosecute before the Municipal Judge all actions on behalf of the City.
2. 
Represent the City in all courts of record.
3. 
Draft, under the instructions of the Mayor, or his/her designee, all ordinances, contracts and prepare legal forms of every kind necessary to the functioning of the City Government.
4. 
Provide legal advice to the City Administrator, Mayor and Board of Aldermen in relation to the business of the City.
5. 
When requested, in writing, he/she shall render opinions on legal questions raised by department heads and by the various boards and committees of the City Government.
6. 
Perform such other legal duties as may be prescribed by ordinance or resolution or which shall be directed by the City Administrator.
C. 
Oath Of Office. The City Attorney shall, before entering upon the duties of his/her office, make and subscribe to an oath before a proper officer that he/she will support the Constitution of the United States and of this State and this Code and other ordinances of the City, that he/she possesses the required qualifications and that he/she will faithfully demean himself in his/her office. The oath shall be filed with the City Clerk.
D. 
Acting City Attorney. In the absence, sickness or disability of the City Attorney, the Mayor may employ an attorney to render any legal service required by the City or any officer thereof. The person so appointed shall be a duly licensed, practicing attorney and shall be a member in good standing with the Missouri Bar Association. Said attorney shall receive for his/her services such compensation as may be agreed upon at the time of such appointment and no other.
E. 
Assistant City Attorney. The Mayor, by and with the advice and consent of the Board of Aldermen, may appoint one (1) or more Assistant City Attorneys, which such Assistant City Attorneys shall possess all of the qualifications required of the City Attorney and shall perform the same duties and enter into the same oath as required of the City Attorney.
