This article shall be known as "A Local Law Abolishing the Offices of Three Elected Assessors and Establishing the Office of a Single Appointed Assessor Pursuant to Real Property Tax Law."
This article is adopted pursuant to New York State Real Property Tax Law § 328.
The purpose of this article shall be to abolish the board of three elected assessors in the Town of Pine Plains and to substitute therewith a single appointed Assessor to be appointed pursuant to Real Property Tax Law § 310.
The offices of three elected assessors as previously established and continued by the Town of Pine Plains is hereby abolished. The terms of office of the three elected assessors shall terminate on December 31, 2023. This article shall terminate all elected assessors inclusive of any assessor elected on November 7, 2023, if any.
In place and stead of three elected assessors, the Town of Pine Plains shall have one single Assessor to be appointed by the Town Board of the Town of Pine Plains in accordance with the provisions of Real Property Tax Law § 310.
Pursuant to § 328 of the Real Property Tax Law, the Town Board of the Town of Pine Plains has opted not to subject this article to a permissive or mandatory referendum on the same.
All other local laws and ordinances of the Town of Plains that are inconsistent with the provisions of this article are hereby repealed; provided, however, that such repeal shall only be to the extent of such inconsistency and in all other respects this article shall be in addition to such other laws or ordinances regulating and governing the subject matter covered by this article.
Should any section or provision of this article be declared invalid, such decision shall not affect the validity of the remaining portions of the article.
This article shall take effect immediately upon being filed in the Office of the New York State Secretary of State in accordance with the provisions of § 328 of the Real Property Tax Law, and pursuant to the provisions of the New York State Municipal Home Rule Law and the term of all elected assessors will terminate on December 31, 2023.
