It shall be unlawful for any person to loiter, assemble or otherwise
remain on that public area of the Town known as the "Memorial Clock"
or the grounds and lawn area surrounding the same for purposes of
loitering or for other idle purposes or for the purpose of consuming
food or beverages, littering, etc.
A violation of this article shall be punishable by a fine not
exceeding $50 or by imprisonment for a term not to exceed 10 days,
or in the event of a subsequent second offense by a fine not to exceed
$150 or imprisonment not to exceed a term of 30 days, or both.

It shall be unlawful for any person other than a public official
to be within the beach area of the Town between the hours of sunset
and sunrise unless prior approval has been granted by the Town Board.
The beach area shall be defined as that portion of the recreational
facilities owned by the Town of Pine Plains adjacent to Stissing Lake
bounded by the waters of Stissing Lake on one side, the rear portion
of the parking area on the other side, and the boundary lines of each
adjoining property owner on the other sides.
The time of sunrise and sunset shall be those times published
daily by the Poughkeepsie Journal.
Any person found in violation of this article by a court of
competent jurisdiction shall be subject to a minimum fine of not less
than $100 and a maximum fine of $250. Any second offender within a
period of 24 months shall be subject to a mandatory minimum fine of
$150 and a maximum fine of $300.
