A. 
The Village of Coloma, Waushara County, Wisconsin, adopts the following chapter for the operation of all-terrain/utility vehicles upon the roadway(s) listed in § 438-3.
B. 
Following due consideration of the recreational value to connect trail opportunities and weighted against possible dangers, public health, liability aspects, terrain involved, traffic density and history of automobile traffic, this chapter has been created.
A. 
This route is created pursuant to Village authority as authorized by § 23.33(8)(b), Wis. Stats.
B. 
The applicable provisions of § 23.33, Wis. Stats., and regulating ATV/UTV operation pursuant to routes are adopted.
Road(s) to be open for ATV/UTV routes are as follows:
A. 
South Slater Road (Cumberland Road) northwest from Town of Coloma town line to East Westfield Road;
B. 
East Westfield Road west to South Front Street south to Town of Coloma town line;
C. 
North 1st Street north to East Main Street;
D. 
East Main Street east to Coloma Hotel parking lot;
E. 
East Main Street west to North Litho Street - ATV parking in Coloma Supermarket parking lot;
F. 
North Litho Street north across Highway 21 to Front Street;
G. 
Front Street north to West North Street;
H. 
West North Street west to Mobil station;
I. 
Mobil station west entrance/exit south to Lavore's on the Hill.
As a condition for the use of these routes, the following conditions shall apply to all operators, and passengers:
A. 
All ATV/UTV operators shall operate at no more than 10 miles per hour.
B. 
All ATV/UTV operators shall ride single file on the extreme right side of roadways.
C. 
All ATV/UTV operators shall only ride on the paved surface of roadways.
D. 
All ATV/UTV operators shall slow the vehicle to 10 miles per hour or less when operating within 150 feet of a dwelling.
E. 
All ATV/UTV operators shall slow the vehicle to 10 miles per hour or less when operating within 100 feet of a nonmotorized vehicle.
F. 
Routes must be signed in accordance with §§ NR 64.12 and 64.12(7)c, Wis. Adm. Code.
G. 
Routes will be open for public ATV/UTV usage daily during the following time periods: 5:00 a.m. through 12:00 midnight.
This chapter shall be enforced by any law enforcement officer authorized to enforce the laws of the State of Wisconsin.
Wisconsin State all-terrain/utility vehicle penalties as found in § 23.33(13)(a), Wis. Stats., are adopted by reference.
The provisions of this chapter shall be deemed severable and it is expressly declared that the county and Village would have passed the other provisions of this chapter irrespective of whether or not one or more provisions may be declared invalid. If any provision of this chapter or the application to any person or circumstances is held invalid, the remainder of the chapter and the application of such provisions to other persons or circumstances shall not be deemed affected.
This chapter becomes effective on publication and posting. The Village Clerk shall properly publish or post this chapter as required under § 60.80, Wis. Stats. However, this chapter is being adopted on a probationary basis and will be reviewed for final consideration one year after signs have been properly placed and routes are open for ATV travel. This chapter will be reviewed on an annual basis by December 31 or at any time deemed appropriate by the Village Board.
