No person shall pump any water or other liquid substance under
his control into or across any sidewalk or street which is serviced
by a sub-surface water drain and no person shall pump any water or
other substance onto land owned or occupied by him in such a manner
as to cause such water or substance to flow onto any such street or
sidewalk.[1]

No person shall ride a bicycle or tricycle upon any of the sidewalks
of the town.
No person shall stand on any public way or sidewalk so as to
obstruct the free passage of travelers.[1]

No person shall, excepting in the performance of some duty required
by law, discharge any gun, pistol, or other firearm in or upon any
public street, public way, public place of public wharf in the Town,
except by written permission of the Chief of Police.

No person shall transport through the streets or ways within
the Town, any substance of any kind unless the same is suitably covered
to prevent its being scattered, blown or deposited in or upon such
streets or ways.

Every owner or occupant of a building or lot of land abutting
upon a hard-surfaced sidewalk in any street or public place in the
town shall cause the snow to be removed from such sidewalk within
a reasonable time after such snow has ceased to fall; except under
unusual or extraordinary circumstances a reasonable time shall be
held to be as follows: If snow falls in the daytime, it shall be removed
from the sidewalk within four hours from the time it shall have ceased
falling; if in the nighttime, it shall be removed on or before 11:00
a.m. next succeeding. The provisions of this section shall apply to
snow falling from any building or accumulating upon such sidewalk
from any other cause.[1]

No person other than an employee in the service of the Town
of Dartmouth or any employee in the service of an independent contractor
acting for the Town of Dartmouth or any such subdivision thereof shall
pile, push or plow snow or ice onto a Town layout, including, but
not limited to, a street, roadway, lane, by-way or sidewalk so as
to impede the flow of traffic or pedestrians on such. Whoever violates
this section shall be punished by a fine of $150. Such provisions
to be enforceable by the Dartmouth Police Department under the provisions
of Massachusetts General Laws, Chapter 40, Section 21D.

A.Â
As used in this By-Law, a motorized scooter shall mean any two tandem
wheeled device that has handlebars, is designed to be stood or sat
upon by the operator and is powered by an electric, gasoline or alcohol
fueled motor that is capable of propelling the device with or without
human propulsion. A "motorcycle" or "motorized bicycle" as defined
in Massachusetts General Laws, Chapter 90, Section 1, are not motorized
scooters.
B.Â
Motorized scooters shall comply with all applicable federal motor
vehicle safety standards.
C.Â
No person under 16 years of age shall operate a motorized scooter
upon any public or Town way within the Town of Dartmouth, or in any
place to which the public has right of access, or on any private property
without permission.
D.Â
Every person operating a motorized scooter shall possess a valid
drivers license or a valid learner's permit.
E.Â
Motorized scooters shall not be operated at a speed greater than
25 miles per hour.
F.Â
Operators shall be subject to all traffic laws and regulations of
the Commonwealth and this By-Law.
G.Â
No licensed person shall operate a motorized scooter upon any of
the following public places within the Town: sidewalk, Town land,
off-street recreational bicycle paths, schools, playgrounds, parks,
or beaches.
H.Â
No person who has a motorized scooter under his/her custody, care
of control, shall allow or permit any other person, licensed or not,
to operate a motorized scooter on any of the following public places
within the Town: sidewalk, Town land, off-street recreational bicycle
paths, schools, playgrounds, parks, or beaches.
I.Â
Every person operating a motorized scooter must wear protective headgear
conforming to minimum standards of construction and performance that
meets current United States Department of Transportation and Commonwealth
standards.
J.Â
No person operating a motorized scooter shall permit any other person
to ride as a passenger on such motorized scooter.
K.Â
No motorized scooter shall be operated upon any way, or in any place
to which the public has a right of access, or in any place which the
public has right of access as invitees or licensees, within the Town
of Dartmouth, Massachusetts between the hours of 1/2 after sunset
and 1/2 hour before sunrise.
L.Â
Whenever a police officer observes any person in violation of any
section of this By-Law, he or she may detain such person for purpose
of the enforcement of this By-Law, and may remove such motor scooter
to a secure area pending a disposition of such property by court ordered
or otherwise by law. Costs incurred for said storage of the motor
scooter will be the responsibility of the owner of the motorized scooter.
M.Â
Any person who violates any section of this By-Law shall be subject
to a fine of $100 for each offense.
N.Â
The provisions of this By-Law are severable. If any provision of
this By-Law is declared invalid or inapplicable to any particular
circumstances, that invalidity or inapplicability will not affect
the enforceability of the remaining portion of this By-Law.
