No outdoor music festival shall be conducted within the Town of Dartmouth without a license from the Select Board. In considering an application for such license, the Selectpersons shall determine whether adequate police and fire protection and health safeguards will be provided.
No license shall be granted until the applicant has furnished a bond in the sum of $100,000 issued by a surety company authorized to do business in the Commonwealth of Massachusetts, conditioned to indemnify the Town of Dartmouth for any loss, damage or liability caused by the conduct of such festival and guaranteeing payment of all expenses incurred by the Town of Dartmouth in providing police and fire protection at such festival. Should it determine that the Town's interests will not be adversely affected, the Select Board may, in its discretion, waive the bond requirement of this By-Law.
