All information maintained by the City pertaining to its customers or account holders including, but not limited to, names, addresses, water usage, sewer usage, trash usage, or any other City service, billings, method of payments and/or depository accounts used in making payments to the City are hereby determined to be private, which privacy shall be honored and protected by the City and its employees.

The City deems any request for information pertaining to any customer other than by the customer himself/herself or anyone listed as the customer or property owner on City records as reported to the City at the time of the commencement of water service, sewer service, trash service, or any other City service, or anytime thereafter or by authorization of the customer or by third parties in the custody of a valid and certified court order authorizing the City to release such information to constitute a "red flag" as the term "red flag" is defined in 16 Code of Federal Regulations (CFR), Part 681.2.

No such identifying information pertaining to any customer of the City shall be disclosed to third parties other than in the circumstances specified in Section 140.020 hereof.

A. 
The City Administrator of the City is hereby directed to establish a training program for all employees of the City, which training program shall include:
1. 
A determination of the information which is maintained regarding each customer of the City;
2. 
The importance the City places on maintaining the privacy and confidentiality regarding such customer information;
3. 
The circumstances under which such information may be disclosed to third parties;
4. 
The identity of the individual employee of the City who is responsible for responding to any such request for information by third parties.

A. 
The City Administrator or City Clerk of the City of Arnold are hereby designated as those individuals with the authority to respond to any requests for identifying information as specified herein by third parties. At the time of the enactment of this Chapter, the City Administrator is Matt Unrein and the City Clerk is Diane Waller.
B. 
Any authorization presented to the City by a third party requesting identifying information pertaining to any customer of the City in accordance with the requirements of Section 140.020 shall be limited to a single request only and shall be deemed by the City to be revoked by the customer following the City's response to any such request. Additional requests can be made by following the requirements of Section 140.020.
C. 
Nothing in this Chapter shall require the City or its employees to refuse to release records, which refusal would otherwise violate the pertinent provisions of Section 610.021, RSMo., as amended ("The Sunshine Law").

Any employee who suspects fraud in the use of customer identifying information which is maintained by the City shall notify the City Administrator who in turn shall notify the customer and/or law enforcement as necessary.
