There is hereby continued in existence the Willimantic Police
Department, including all current personnel, administrative staff,
equipment and other items of personal property, contracts, rights,
liabilities, and all other assets of the department, whether real
or personal and wheresoever located. The Common Council shall determine
the level of manpower, administrative staff and the compensation for
department personnel as it deems appropriate.

It shall be the duty of the Chief of Police to superintend the
Police Department and he may make or prescribe such rules and regulations
as he shall deem advisable for the efficient operation of the department,
and from time to time report to the city manager the state of the
department. He shall also keep all the records of the Police Department
and a roster of all the officers and members, and all the reports
shall be made by him at the headquarters of the department. He shall
receive from any subordinate member of the police force, and from
every other person, all complaints of any violation of any law of
the state, or ordinance of the city, and shall see that the same be
prosecuted before the proper court. All members of the force shall
be subject to his orders. He shall from time to time designate the
officers to attend court. He shall at all times be under the direction
of the Common Council and city manager have the management and control
of the police force. He shall be on duty as prescribed by the policies
of the Common Council and shall receive and execute all orders from
the city manager. It shall be the duty of the Chief of Police to place
any mittimus issued in any case where the arrest was made by any police
officer of the City of Willimantic, or which shall issue out of the
court of jurisdiction into the hands of some proper officer for service,
which officer shall not be a patrolman who is assigned to regular
duty.

Every person appointed to an office in the Police Department
shall have been, at the time of his appointment, for three years next
preceding, a citizen of the United States, and capable of speaking,
reading and writing the English language; and shall, before exercising
any function of his office, make oath or affirmations before some
competent authority that he will support the Constitution of the United
States and the Constitution of the State of Connecticut, and that
he will faithfully discharge the duties of the office to which he
shall have been appointed and shall cause a certificate of such oath
or affirmation to be lodged with the City Manager.

Whenever services of any regular member of the police force
may be required by persons other than the City of Willimantic the
Chief of Police may, if, in his judgment, the interests of the city
will not suffer thereby, detail such regular member or members of
the force as he shall judge expedient and shall charge such persons
for such services so rendered such sums as may be established which
sum shall include all necessary expenses. The Chief of Police shall
keep a record of all such services performed, the names of the persons
for whom and the names of the policemen by whom performed, the time
spent, the expenses incurred, the sum charged, the amount and date
of payment, together with such other memoranda as may be proper.

(a)Â
The Chief of Police shall have the power to take appropriate disciplinary
action against members of the Police Department, which shall include
the power to suspend policemen from office for cause, and to remove
such policemen from the department for cause; but such suspension
or removal shall not continue for more than 30 days thereafter, unless
he shall within that time notify each member of the Common Council
in writing of such suspension or removal, the grounds therefore and
the names of the witnesses to sustain such charges. Such notice in
writing shall be sufficient if made to each member of the Common Council
individually. The Common Council need not convene to receive such
notice.

Written notice of the particulars of the charges against the accused
shall be given to him within 48 hours thereafter. Not more than 15
days after such notice to the accused, upon request by the accused
or his counsel on his behalf for a hearing, the Common Council or
a committee of their own number shall hear and examine witnesses under
oath or affirmation upon the charges and in defense; and the Common
Council may continue the suspension, remove the accused from office,
or restore him to duty. The patrolman against whom charges have been
made shall have the right to employ counsel to represent him at the
hearing and shall be given a reasonable time within which to prepare
a defense thereto. The party suspended or removed shall be deprived
of his pay from the date of his suspension or removal until such time
as he may be restored.

The violation of any laws of the state or ordinances of the City
of Willimantic or of any rule or ordinance of the Police Department,
or disobedience of the lawful orders, rules and regulations of the
Chief of Police, shall be grounds for suspension or dismissal or other
disciplinary action.
(d)Â
Complaints regarding members of the Police Department may be made
either to the Common Council or to the Chief of Police.
(e)Â
The Chief of Police shall assign all members of the department to
their respective posts, shifts, details and duties. He shall make
rules and regulations concerning the operation of the department and
the conduct of all officers and employees thereof. He shall be responsible
for the efficiency, discipline and good conduct of the department
and for the care and custody of all property used by the department.
(f)Â
The Chief of Police shall make appointments to the Police Department,
or promotions within the department, subject to the approval of the
Common Council.
(g)Â
The Mayor may remove the Chief of Police subject to the provisions
of G.S. 7-278.

The departmental, vendor, soliciting street fest and parking
permit fees are effective July 1, 2009 and the parking ticket fees
are effective immediately per ordinance. This section supersedes any
and all other ordinances.
