A. 
There is hereby established a sanitary sewer user charge effective July 1, 2016, to be imposed upon the owner of real property within the Borough limits served thereby at the rates hereinafter set forth, for the use, operation, maintenance and replacement of the sanitary sewer system of the Borough and for collecting, treating and disposing of sewage.
B. 
The sanitary sewer user charge is applicable to all owners of real property, inclusive of both taxable and tax-exempt properties, which property is connected with the sanitary sewer system.
C. 
The sanitary sewer user charge will be calculated based upon the actual cost to the Borough of Rockaway imposed by Rockaway Valley Regional Sewerage Authority together with other costs for operation of the Sewer Department and will be charged as provided in Chapter A263, Fees.
A. 
The Borough will endeavor to render bills to the owner of the premises for sanitary sewer and other Borough charges, but the nonreceipt of a bill covering such charges will be no excuse for failure to pay or delay in paying the same.
B. 
Sanitary sewer user charges shall be billed concurrent and in conjunction with the water bill and shall be due and payable immediately to the clerk of the water utility. If any bill or part thereof rendered for sewer usage is not paid within 30 days, the bill or unpaid part shall be considered delinquent and subject to interest at the prevailing rate fixed for interest on delinquent water bills from the billing date until the bill is paid in full.

C. 
Payments will be applied in the first place to interest, if any, due on the account, and in the second place to the water bill balance. When the water bill balance has been paid in full, payment will be applied to the sewer bill. Any over payment will be applied as a credit to the water bill.
D. 
The owner of any house, tenement, building or lot shall be liable for the payment for the use of sewer on such premises, and, if not paid, the Borough shall have a lien upon such house, tenement, building or lot until the same shall be paid and satisfied. The Borough shall have the same remedies for the collection therefor with interest, costs and penalties as it has by law for collection of taxes upon real estate.
E. 
Authorized employees or agents of the Borough bearing proper credentials and identification shall be permitted to enter upon all properties for the purpose of inspection, observation, measurement, sampling and testing to assure proper use of the sewer system.
The rates per quarter shall be as provided in Chapter A263, Fees.
The user fees shall provide for flow not directly attributable to users (i.e., infiltration/inflow) and shall be distributed among all users of the sewer system in accordance with the formula set forth herein.
Whenever a property upon which a sanitary sewer use charge is imposed uses water that is not discharged into the sanitary sewer system, the quantity of water used and not discharged into the system shall be excluded in determining the sanitary sewer use charge for the property. The quantity of water used and not discharged into the system shall be measured by a device or meter approved by the Borough and installed without cost to the Borough, or by other means approved by the Borough. The sanitary sewer user fee based upon service shall be computed at the rates provided for, less the quantity of water not discharged into the system.
