The following words, terms and phrases, when used in this Article, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
UNCLAIMED PERSONAL PROPERTY
Any motor vehicle or other personal property which has been impounded or otherwise comes into the possession of the Police Department, and after a reasonable effort to locate the owner of such property, the owner cannot be found or fails and refuses to claim such property, and such property has been in the continued possession of the Police Department for at least thirty (30) days.

A. 
Officers of the Town Police Department are hereby authorized to commence actions in the Circuit Court of the County pursuant to RSMo. 195.140 and 195.146, for the forfeiture of properties as set out in those statutes.
B. 
The Town Police Department is hereby authorized to request the retention of and to retain property forfeited pursuant to the Criminal Activity Forfeiture Act, RSMo. 513.600 et seq. Any property retained, and a statement of its value, must be reported to the Town Administrator and the Mayor in writing.
C. 
The Town Police Department is hereby authorized to request the transfer to it of property forfeited pursuant to 21 U.S.C. § 881(e) and 19 U.S.C. § 1616(c) if it is eligible for such a transfer, and to do such acts necessary to make such a request. Copies of all such requests must be given to the Town Administrator and Mayor in writing. Disbursements of money must be made to the Finance Director/Treasurer, who will place the money in a special fund for the use of the Town Police Department in its official functions. Any property retained, and a statement of its value, must be reported to the Town Administrator and the Mayor in writing.

A. 
The Police Chief is hereby authorized to dispose of all unclaimed personal property, as he/she deems proper under the circumstances, except:
1. 
Firearms; and
2. 
Any property which may be evidence in a criminal prosecution.

The Town Clerk shall cause notice of any auction sale under this Article to be published in any legal newspaper at least seven (7) days prior to such sale.

The proceeds of any auction sale of unclaimed personal property shall be deposited to the general revenue of the Town as additional budgeted funds for the Police Department.

The Chief of Police shall file with the Town Clerk within ten (10) days following any sale under this Article an itemized list of all property sold, the sale price and the name of the purchaser.
