As used in this Chapter, the following terms shall have the meanings indicated:
ACCESSORY BUILDING OR USES
A subordinate building having a use customarily incident to and located on the lot occupied by the main building, or a use customarily incident to the main use of the property. A building housing an accessory use if considered an integral part of the main building when it has any part of a wall in common with the main building, or is under an extension of the main roof and designated as an integral part of the main building.
AGRICULTURAL USES
The use of a tract of land of not less than five (5) acres for the growing of crops, pasturage, nursery, or the raising of poultry, including the structures necessary for carrying out farming operations and the residence or residences of those owning or operating the premises, a member of the family thereof, or persons employed thereon, and the family thereof, but such use shall not include feed lots as defined by State Statute.
ALLEY
The minor way which is used primarily for vehicular service access to the back or side of properties otherwise abutting on a street.
ALTERATION
Alteration, as applied to a building or structure, is a change or rearrangement in the structural parts of an existing building or structure. Enlargement, whether by extending a side, increasing in height, or the moving from one (1) location or position to another shall be considered as an alteration.
APARTMENT
A room or suite of rooms in an apartment house arranged, intended, designed for or used as the place or residence, or a single family or group of individuals living together as a single housekeeping unit.
APARTMENT HOUSE
A building arranged, intended, designed for or occupied by two (2) or more families.
ARTERIAL STREET
A street that serves through-traffic movement across the Town.
BASEMENT
The area below ground level directly beneath the main structure.
BLOCK
That property abutting on one (1) side of a street between the two (2) nearest streets or other natural barriers.
BOARDING, LODGING, AND BED-AND-BREAKFAST HOUSES
A building other than a hotel, occupied as a single housekeeping unit, where lodging and meals are provided for three (3) or more persons for compensation, pursuant to previous arrangements, but not for the public or transients.
BUILDING LINE
A building limit fixed at a specific distance from the front, rear and side boundaries of a lot beyond which a structure cannot lawfully extend.

BUILDING, FRONT LINE OF
The line of that face of the building nearest the front property line of the lot. This face shall include sun parlors and covered porches, whether enclosed or unenclosed, but does not include steps.
CAMPGROUNDS
Any piece, tract or plot of ground which provides space for transient occupancy and is used or intended to be used for the parking of one (1) or more recreational vehicles. The term campground does not include sales lots on which unoccupied recreational vehicles, whether new or used, are parked for the purpose of storage, inspection or sale.

CAMPING TRAILER
Any vehicular portable dwelling unit designed especially for short-term occupancy, such as travel trailers, tent trailers, truck or auto-mounted camping units, converted buses and trucks, and all other similar units whether self-propelled, pulled or hauled, and designed primarily for highway travel without the necessity of a special permit.
CLINIC
A building arranged, intended, designed for, or used solely as a place for the treatment and diagnosis of non-resident patients.
CONDITIONAL USE PERMIT
A permit that may be located in zoning districts, provided it will not be detrimental to public health, moral and welfare, and will not impair the character of the zoning district.

CURB CUT
Making a break in an existing curb and gutter for the purpose of ingress and egress of vehicles from a street. Where no curbs exists, any structure placed across or in a drainage ditch shall be considered a curb cut.
DAYCARE, PRESCHOOL CENTER, NURSERY SCHOOL or SIMILAR FACILITIES
1. 
A family daycare home is a family home occupied by the daycare provider, in which family-like care, training or instruction is given to four (4) children or less, not related to the provider, for any part of the twenty-four-hour day. Such facilities caring for more than four (4), but not exceeding ten (10) children shall comply with the State of Missouri regulations.
2. 
A group daycare home is a family home occupied by the daycare provider, in which family-like care, training or instruction is given to eight (8) or fewer children, not related to the daycare provider, for any part of the twenty-four-hour day. Such facilities shall comply with the State of Missouri regulations.
3. 
A daycare center is any facility, other than a family home occupied by the daycare provider, which receives more than four (4) children for care, training or instruction for any part of the twenty-four-hour day, or any facility in a family home occupied by the daycare provider which receives more than ten (10) children for care, training or instruction for any part of the twenty-four-hour day. Such facilities shall comply with the State of Missouri regulations.
DOUBLE FRONTAGE
A parcel of ground that abuts one (1) street on the front, and also abuts one (1) street on the side.
DRIVEWAY
An area established or used for ingress and egress of vehicles from a street or thoroughfare to any point on private property.
DUPLEX
A building or portion thereof designated for occupancy by two (2) families.
DWELLING
A building or portion thereof designated exclusively for residential occupancy, including single-family, two-family, and multiple dwellings, boarding, lodging, bed-and-breakfast, apartment houses, apartment hotels, but not hotels.
DWELLING, MULTIPLE
A dwelling or group of dwellings on one (1) plot, each containing separate living units for two or more families, but which may have joint services or facilities.
DWELLING, SINGLE-FAMILY
A detached building arranged, intended for occupancy by one (1) family. Pursuant to Section 89.020, RSMo., the term "single-family dwelling" includes "group home" as defined in this Section.
EASEMENT
The right to use property owned by another for specific purposes such as utility facilities and maintenance access.

FACTORY-BUILT HOME
See "modular home or unit" definition.
FAMILY
1. 
An individual or married couple and the children thereof and no more than two (2) other persons related directly to the individual or married couple by blood or marriage (excluding servants), except that a family may include not more than one (1) additional person not related to the family by blood or marriage, provided that such additional person may be provided with sleeping accommodations but not with kitchen facilities; or
2. 
A group of not more than four (4) persons not related by blood or marriage living together by joint agreement and occupying a single housekeeping unit with single kitchen facilities on a non-profit cost-sharing basis.
FINDING
A determination or conclusion based on the evidence presented by a hearing body in support of its decision.

FRONT YARD
An open space, unoccupied, except as hereinafter provided, across the full width of the lot extending from the front line of the building to the front property line of the lot.
FRONT YARD DEPTH
The minimum horizontal distance from the front line of the building to the front property line of the lot.
FRONTAGE
The length of the property abutting on one (1) side of a street measured along the dividing line between the property and the street.
GARAGE, COMMUNITY
A group of minor garages, one (1) story in height, arranged in a row or surrounding a common means of access and erected for the use of adjacent property owners having no minor garage on their individual lots.
GARAGE, PRIVATE
An accessory building housing not to exceed four (4) motor-driven vehicles, the property of and for the use of the occupants of the lot on which the private garage is located.
GARAGE, PUBLIC
Any garage other than a private garage, available to the public, operated for gain, and which is used for storage, repair, rental, greasing, washing, servicing, adjusting, or equipping of automobiles or other motor vehicles.
GROUP HOME
The classification of single-family dwelling or single-family residence shall include the following:
1. 
Any home in which eight (8) or fewer unrelated mentally or physically handicapped persons reside, and may include two (2) additional persons acting as houseparents or guardians who need not be related to each other or to any of the mentally or physically handicapped persons residing in the home. The exterior appearance of the home and property shall be in reasonable conformance with the general neighborhood standards. Should such a single-family dwelling or single-family residence cease to operate for the purpose as set forth herein, any other use of such home, other than allowed by this Chapter, must be approved by the Planning and Zoning Commission.
2. 
Any private residence licensed by the Children's Division or Department of Mental Health to provide foster care to one (1) or more but less than seven (7) children who are unrelated to either foster parent by blood, marriage or adoption. Nothing in this Subsection shall be construed to relieve the Children's Division, the Department of Mental Health or any other person, firm or corporation occupying or utilizing any single-family dwelling or single-family residence for the purposes specified in this Subsection from compliance with any ordinance or regulation relating to occupancy permits except as to number and relationship of occupants or from compliance with any building or safety code applicable to actual use of such single-family dwelling or single-family residence.
HOME-BASED BUSINESS (also called HOME OCCUPATION)

1. 
As used in this Division, the following terms mean:
a. 
GOODSAny merchandise, equipment, products, supplies, or materials.
b. 
HOME-BASED BUSINESS OR HOME OCCUPATIONAny business operated in a residential dwelling that manufactures, provides, or sells goods or services and that is owned and operated by the owner or tenant of the residential dwelling.
2. 
Authorization. Any home-based business owned or operated by the owner or tenant of the residential dwelling unit that is "no impact" pursuant to State law (Sections 71.990 and 89.500, RSMo.), including, being incidental and secondary to the principal use of the residential dwelling unit, shall be permitted in any such residential dwelling subject to the provisions set forth herein. Any person who resides in a residential dwelling may use the residential dwelling for a home-based business unless such use is restricted by:
a. 
Any deed restriction, covenant, or agreement restricting the use of land; or
b. 
Any master deed, bylaw, or other document applicable to a common-interest ownership community.
3. 
Purpose Of Regulation. Home-based businesses shall be regulated so as to:
a. 
Ensure compatibility of home-based businesses with all uses permitted in the "R-1," "R-2," and other Districts.
b. 
Promote the health, safety, and general welfare of residential neighborhoods by preventing excessive noise, traffic, nuisances, fire hazards and other adverse effects of unregulated home-based businesses.
c. 
Establish standards for home-based businesses in residential units.
4. 
Use Limitations. All home-based businesses shall comply with the following provisions to preserve residential appearance, prevent adverse impacts on the character of the surrounding neighborhood, and protect public health and safety:
a. 
The use of the residential dwelling unit for the home-based business shall be clearly incidental and secondary to its use for residential purposes by its occupants and shall under no circumstances change the residential character thereof.
b. 
Home-based businesses shall be subject to all applicable laws and its activities shall be limited to the sale of lawful goods and services.
c. 
The total number of employees and clients on-site at one (1) time shall not exceed the occupancy limit for the residential dwelling unit.
d. 
The activities of the business shall only occur inside the residential dwelling unit or in the yard and shall not be visible from the street.
e. 
No alteration to the exterior experience of the residential building or premises shall be made which detracts from its residential character.
f. 
No home-based business shall involve commercial vehicle (as defined in Section 300.010 of the Municipal Code of the Town of Carrollton) traffic on or in the vicinity of the residence.
g. 
No mechanical equipment or process shall be used that creates excessive noise, vibration, glare, fumes, odors, electrical interference, or fluctuations in line voltage outside the residential dwelling unit.
h. 
Notwithstanding anything to the contrary, no advertising, identification or business exterior displays or signs are permitted on any residential premises,
i. 
Traffic generated by such home-based business shall not exceed volumes than would normally be expected in the residential area and any need for parking generated by the conduct of such home-based business shall be met by lawful off-street parking.
j. 
There shall be no exterior storage of equipment, commodities, inventory, or material used in connection with the home-based business.
HOTEL
A building or portion thereof, or a group of buildings, used as a transient abiding place which may or may not serve meals whether such establishments are designated as a hotel, inn, automobile court, motel, motor inn, motor lodge, motor court, tourist cabin, tourist court, or other similar designation.
INSTITUTION
A building occupied by a non-profit corporation or a non-profit establishment for public use.
INTERSECTION
The place where two (2) or more streets meet or cross.
KENNEL
Any structure or premises where five (5) or more dogs and/or cats over four (4) months of age are kept.
LAUNDROMAT
A business that provides home-type washing, drying, and/or ironing machines and/or dry-cleaning machines for hire, to be used by customers on the premises.
LOADING SPACES
A space within the main building, or on the same lot therewith, providing for the standing, loading or unloading of trucks.
LOT
A parcel, tract, or area of land accessible by means of a street or place. It may be a single parcel separately described in a deed or plat which is recorded in the office of the County Recorder, or it may include parts of or a combination of such parcels when adjacent to one another and used as one (1).
LOT LINE, FRONT
In the case of an interior lot, a line separating the lot from the street of place; and, in the case of a corner lot, a line separating the narrowest frontage of the lot from the street.
LOT, CORNER
A lot at the junction of and having frontage on two (2) or more intersecting streets.
LOT, INTERIOR
A lot other than a corner or through lot.
LOT, THROUGH
A lot facing frontage on two (2) parallel or approximately parallel streets and which is not a corner lot.
LOT, WIDTH
The dimension of a lot, measured between side lot lines on the building line.
MOBILE HOME
A factory-built residential structure or structures equipped with the necessary connections and made so as to be readily movable as a unit or units on its own running gear and designed to be used as a dwelling unit, equipped with the necessary service connections and made so as to be readily movable as a unit with or without permanent foundation. The phrase "without permanent foundation" indicates that the system is constructed with the intent that the mobile home placed thereon may be moved from time to time at the convenience of the owner, and meets the State of Missouri Certificate of Mobile Home designation.

MOBILE HOME PARK
Any area, piece, parcel, tract or plot of ground equipped as required for support of mobile homes and used or intended to be used by two (2) or more occupied mobile homes, but under no circumstances shall the mobile home spaces be sold or offered for sale individually. The term "mobile home park" does not include sales lots on which unoccupied mobile homes, whether new or used, are parked for the purpose of storage, inspection or sale.
MOBILE HOME SPACE
A plot of ground within a mobile home park which can accommodate one (1) mobile home and which provides the necessary utility services for water, sewerage, and electricity.
MODULAR HOME OR UNIT
A factory-fabricated transportable building unit designed to be used by itself or to be incorporated with similar units at a building site into a modular structure to be used for residential, commercial, educational, or industrial purposes.
NON-CONFORMING USE, BUILDING OR YARD
One that does not, by reason of design or use, conform to the regulations of the district in which it is situated.
NURSING HOMES or CONVALESCENT HOMES
An institution or agency licensed by the State for the reception, board, care of treatment of three (3) or more unrelated individuals, but not including facilities for the care and treatment of mental illness, alcoholism, or narcotics addition.
PARKING SPACES, OFF STREET
A permanently surfaced area (concrete, asphalt, or compacted gravel) of sufficient size to park one (1) motor vehicle, having the minimum dimensions of eight and one-half (8 1/2) feet by twenty (20) feet, to which a motor vehicle has direct access from a driveway which complies with Section 503.010 of this Code.

PLACE
A open, unoccupied space other than a street or alley permanently established or dedicated as the principal means of access to property abutting thereon.
PROPERTY LINE
The line bounding a lot as defined herein as shown or depicted on the official plat, deed, or property title instrument for said property parcel.
PUBLIC UTILITY
Any business which furnishes the general public telephone service, telegraph service, electricity, natural gas, water and sewer, any other business so affecting the public interest as to be subject to the supervision or regulation by an agency of the State.
REAR LINE
The boundary line which is opposite and most distant from the front street line, except that in a case of uncertainty the Planning and Zoning Commission shall determine the rear line.
REAR YARD
An open space, unoccupied (except as hereinafter provided) between the rear lot line and the rear line of the principal building and the side lot lines.
REAR YARD DEPTH
The minimum horizontal distance from the rear line of the principal building to the rear lot line.
RECREATIONAL VEHICLE
A vehicular unit mounted on wheels, designed to provide temporary living quarters for recreational, camping or travel use of such size or weight as not to require special highway movement permits when drawn by a motorized vehicle.

RESTAURANT
A building wherein food is prepared and served to the public in ready-to-eat form. The term shall include cafe, cafeteria, grills, pizza parlor, diner, snack shop, hamburger shop and steak house.
RESTAURANT, DRIVE-IN
An establishment where, for compensation, food is prepared and dispensed and normally consumed on the premises but not necessarily within the confines of the building.
REVERSION CLAUSE
A requirement that may accompany a variance, re-zoning, or conditional use permit that returns the property to its prior classification if a specified action, such as taking out a building permit or beginning of construction, does not begin in a specified period of time.

RIGHT-OF-WAY
The right of passage over the property of another.

ROOMING HOUSE
A rooming house is a building other than a hotel where lodging is provided for three (3) or more persons for compensation pursuant to previous arrangements but not open to the public or transients.
SCREENING and LANDSCAPING
A privacy barrier of densely-planted compact evergreen hedge, not less than five (5) feet in height, or a solid wall, made of stone or wood, not less than five (5) feet in height or more than six (6) feet in height, with materials being approved by the Planning and Zoning Commission.
SERVICE STATION
A service station shall consist of a building or group of buildings and surfaced area where automobiles and vehicles may be refueled and serviced, self-service pumps without building shall also be included. Such service shall not include tire recapping, body repair or major overhauls.
SIDE LINE
Any lot boundary line not a front or rear line thereof separating two (2) privately owned properties.
SIDE STREET
A street joining and often terminated by a main thoroughfare.
SIDE YARD
An open space, unoccupied, except as hereinafter provided, between the main building and the adjacent side line of the lot, and extending through from the front yard to the rear yard.
SIGN
Any device which shall display or include any letter, word, model, banner, flag pennant, insignia, device or representation used as, or which is in the nature of an advertisement or announcement which directs attention to an object, product, place, activity, person, institution, organization or business, but shall not include any display or official notice or official flag.
SIGHT TRIANGLE
An area at a street intersection in which nothing shall be erected, placed, planted or allowed to grow in such a manner as to materially impede vision between a height of two and one-half (2 1/2) feet and eight (8) feet above the grades of the bottom of the curb of the intersecting street, measured from the point of intersection of the centerline of the streets, ninety (90) feet in each direction along the centerline of the streets. At the intersection of major or arterial streets, the ninety-foot distance shall be increased to one hundred twenty (120) feet.
SPECIAL USE PERMIT
A written permit issued by the Zoning Administrator with the written authorization of the Planning and Zoning Commission. This special use permit provides permission under special conditions to make certain special uses for land in certain zoning districts as stipulated in each of the district zoning regulations.
STABLE, PRIVATE
An accessory building for the keeping of horses, ponies, mules or cows, owned by occupants of the premises, and not kept for remuneration, hire, or sale.
STREET
A public thoroughfare which affords principal means of access to property abutting thereon.
STREET LINE
The dividing line between the street and the abutting property.
TAVERN
An establishment in which the primary function is the public sale and serving of alcoholic and cereal malt beverages for consumption on the premises, including establishments commonly known as key clubs, which are open and in which alcoholic and cereal malt beverages are served only to members and their guests.
TRAVEL TRAILER
1. 
A vehicular portable structure built on a chassis and designed for temporary occupancy for travel, recreational or vacation uses and when factory equipped for the road.
2. 
A structure designed to be mounted on a truck chassis for use as a temporary dwelling for travel, recreation and vacation use.
VARIANCE
The granting of permission by the Zoning Board of Adjustments to allow the development of uses not normally permitted within a given zoning district without strict adherence to specific controls, such as dimensional limitations in side yards, height, lot coverage, etc. A legal variance must maintain the basic purpose and intent of the zoning regulations while permitting logical development of land which otherwise appears unduly restricted.
YARD
A space within the same lot, with a main building, open, unoccupied and unobstructed by buildings or structures from the ground upward.
ZONING ADMINISTRATOR
The person or persons authorized and empowered by the Governing Body having jurisdiction to administer the requirements of this Chapter.
