The provisions of this Appendix 27A, "Flood Hazard Area (Overlay District) Regulations," to this chapter of Lower Macungie Township are enacted pursuant to and in compliance with the authority of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq., the Pennsylvania Flood Plain Management Act (Act 66), 32 P.S. § 679.101 et seq., the Flood Insurance Act of 1968, and the Flood Disaster Act of 1973, as amended, for the purposes noted in those statues and in § 27-1901 of this chapter.

It shall be unlawful for any person, partnership, business or corporation to undertake, or cause to be undertaken, the construction, reconstruction, enlargement, alteration or relocation of any building or structure, or the development of any real estate, unless a building permit evidencing compliance with these flood hazard area regulations has been obtained from the Lower Macungie Township Zoning Officer.

A building permit shall not be required for minor repairs to existing buildings or structures, provided that no structural changes or modifications are involved.

The granting of a building permit or approval of a subdivision or land development plan in an identified flood prone area shall not constitute a representation, guarantee, or warranty of any kind by the Township of Lower Macungie, or by any official or employee thereof, of the practicability or safety of the proposed use, and shall create no liability upon the Township of Lower Macungie, its officials, or employees.

If there is any conflict between any of the provisions of this chapter, the more restrictive shall apply.
