A Police Department is hereby formally established in and for
the Township of Collier.

Subordinate to the Board of Commissioners of the Township of
Collier, there is hereby established a Chief of Police and such other
subordinate officers and patrolmen as the Township Commissioners may
appoint from time to time. The number of persons to serve in each
of such classifications on a full time or part time basis and the
compensation of each shall be determined by the Township Commissioners

The general authority of the Township policemen, the manner
of their appointments, selections, promotions, suspensions, and removal
and the powers of the Commissioners of Collier Township are all set
forth in the First Class Township Code, 53 P.S. § 55101
et seq., and it is under the authority of said Code that this part
is enacted, it being the intention of the part that all matters in
connection therewith shall be governed and regulated as provided in
said Code.

The Board of Commissioners may designate one person as the Chief
of Police of the Township of Collier who shall be approved by a majority
vote of the Commissioners of the Township of Collier and who shall
serve until his successor is duly designated by the Commissioners
of the Township of Collier.

The position of Chief shall be a noncivil service position.
2.
That should the Commissioners of the Township of Collier designate
an employee of the Township police force as the Chief of Police that
person then shall be given the option to return to his position with
the Collier Township Police Department at the salary and benefits
that he would have had he not accepted the position of Chief of Police.

The Chief of Police shall be directly responsible to the Board of
Commissioners through the Chairman of the Public Safety Committee.

The Chief of Police shall have the sole responsibility for organizing,
supervising and operating the police department subject to the approval
of the Chairman of the Public Safety Committee.

In the event that the position created by this part is filled from
any person presently serving as a member of the Collier Township police
force, then that person shall continue to receive any benefits presently
being received as a member of the Collier Township Police Department
including police pension retirement fund benefits.

The Board of Commissioners shall fix an annual salary and working
conditions for the position, said salary to be fixed by resolution
of the Board on a yearly basis.
7.
The working hours of the position shall vary inasmuch as the Chief
of Police shall have total control of the Police Department and be
responsible for its day to day operation, said position to be a management
position and not eligible for arbitration through the Police Arbitration
Act or Acts.
