A. 
It shall be unlawful for any person to remove, or cause to be removed, any underground fuel storage tank without first having obtained a permit to do so from the Construction Code Official.
B. 
Notwithstanding anything to the contrary contained in Subsection A above, no permit shall be issued to any persons between November 1 and March 1 of each calendar year, subject to the articulated exceptions found in § 366-37.
This article shall not apply to removal of underground storage tanks under emergency conditions resulting from natural forces or human activities beyond the control of the applicant, or which pose an imminent or existing threat to the safety and security of persons or property, or both, or which require immediate action to prevent bodily harm or substantial property damage from occurring. The provisions of § 366-36 of this article shall not apply when an applicant undertakes any action in response to such an emergency, provided that the applicant notifies the Construction Code Official of the City at the earliest reasonable opportunity.
