It shall be unlawful for any person to park or leave standing
any vehicle on lands of another, whether publicly or privately owned,
in the Township of Washington, after notice has been posted as hereinafter
provided by the owner, occupant, lessee or licensee prohibiting such
parking. Nothing herein contained shall apply to any lands lying within
the bounds of any public street or highway.
Suitable signs not less than 18 inches by 24 inches bearing
the words "no parking," together with any qualifications or restrictions
of such parking, if any, and conspicuously displayed shall be posted
on said lands by the owner, occupant, lessee or licensee thereof where
this article is effective. Defacing, tampering with or damaging such
signs when posted shall constitute a violation of this article.[1]

As used in this article, the following terms shall have the
meanings indicated:
A motor vehicle displaying any advertising, including but
not limited to commercial lettering, name and/or address of an individual
or entity or commercial graphics or other medium, or which bears a
license plate reflecting or consistent with commercial usage.
Every device in, upon or by which person or property is or
may be transported upon a roadway, which is propelled otherwise than
by human power.
Every road, driveway, parking yard or other privately owned
nongaraged land within the Township of Washington.
Between the hours of 12:00 midnight and 6:00 a.m.
The following zones as defined in Chapter 580, Zoning, of the Code of the Township of Washington: AAA, AA, A, B and PRTD.
No commercial vehicle having any one of the following characteristics
shall be parked on private premises in a residential zone during prohibited
hours:
Not more than one nonprohibited commercial vehicle shall be
parked on private premises in a residential zone in the Township of
Washington during prohibited hours.
A.
Any commercial vehicle having a manufacturer's vehicle weight
or gross vehicle weight of less than 14,000 pounds and heretofore
issued a permit by the Township of Washington pursuant to Ordinance
No. 81-6 and/or Ordinance No. 81-19[1] shall be exempt from the provisions of § 330-4. No commercial vehicle having a manufacturer's vehicle weight or gross vehicle weight of 14,000 pounds or more shall be exempt from the provisions of § 330-4. Each exempt commercial vehicle, regardless of the total number thereof, under this section shall be deemed the single nonprohibited commercial vehicle under § 330-5.

B.
In the event that an exempt commercial vehicle under this section
is replaced by its owner, the exemption under this section shall apply
to each such replacement vehicle, provided:
(1)
At any time prior to replacement hereunder, the exempt vehicle shall be inspected by the Police Department, without charge, at which time the Police Department shall be authorized to request and receive documentation as to the manufacturer's or gross vehicle weight of the exempt vehicle. Such inspection shall be for the purpose of recording the specifics of the exempt vehicle as to each type of characteristic set forth in § 330-4. In the absence of such an inspection by the Police Department, the exemption under this section shall not apply to any replacement vehicle.
(2)
No replacement vehicle shall be exempt under this section if any one characteristic listed in § 330-4 exceeds such characteristic of the exempt vehicle being replaced.
(3)
Exemption under this section shall continue for an exempt commercial
vehicle or replacement vehicle in the event that the ownership of
same is transferred, provided that such vehicle is parked during prohibited
hours only at the address in the Township of Washington as appears
on file with the Township Police Department.
A.
In order to be parked in a residential zone during prohibited hours,
a commercial vehicle shall be required to display a permit affixed
thereto by the Police Department. Any commercial vehicle parked in
a residential zone during prohibited hours without displaying a permit
shall be in violation of this article.
B.
The application for and issuance of such permits shall be governed
by the following procedure:
(1)
Any person wishing to park a commercial vehicle in a residential
zone during prohibited hours shall have said vehicle inspected by
the Police Department.
(2)
The Police Department shall be authorized to request and receive from such person documentation as to the manufacturer's or gross vehicle weight of the subject vehicle. The Police Department shall inspect each vehicle to determine if it has any one of the characteristics set forth in § 330-4. If it does not, the Police Department shall affix a permit to the vehicle.
(3)
The Police Department shall collect from any person submitting a commercial vehicle to inspection the sum set forth in Chapter 212, Fees, per each inspection prior to initiating any inspection.

(4)
Permits issued under this section shall not be transferable in any
manner.
(5)
The Police Department shall maintain records of all inspections and
permits, including the registered owner of each commercial vehicle
and the address at which each commercial vehicle shall be parked in
a residential zone during prohibited hours.

Any person convicted of violating the provisions of Article I of this chapter shall be subject to the penalties authorized pursuant to § 1-1, Chapter 1, of the Code. Any person convicted of violating the provisions of Article II of this chapter shall be subject to the following penalties:
A.
For the first violation, a penalty of $100;
B.
For a second offense occurring after 10 days from the issuance of
a first violation, a penalty of $500;
C.
For a third offense occurring after 10 days from the issuance of
a second violation, a penalty of $1,000;
D.
For a fourth offense occurring after 10 days from the issuance of
a third violation, a penalty of $1,500;
E.
For each offense occurring after 10 days from the issuance of a fourth
violation, a penalty of $2,000.
