A Planning Commission is hereby established, which shall have all the powers and duties conferred upon it by the Board of Supervisors, as permitted by law.

1. 
The Planning Commission shall consist of seven members, all of whom shall be residents of the Township of North Fayette.
2. 
The members of the Planning Commission shall be appointed by the Board of Supervisors by resolution which shall also state the term to be filled by each planning commissioner.

The term of office of the members shall be four years and should expire on December 31 or until a successor is appointed, except that for the terms of the members first appointed, no more than two shall be reappointed or replaced during any future calendar year.

In the event of vacancies, the Board of Supervisors shall appoint a member to fill the unexpired term.

The Planning Commission shall make an annual report to the Board of Supervisors of the Township, showing its transactions and recommendations.

The purpose of the Planning Commission shall be to provide advisory recommendations to the Board of Supervisors on certain land development and subdivision applications submitted to the Township for the Board's approval. These recommendations shall be based on the specific requirements of the Township's Zoning, Subdivision, and Land Development Ordinances. The Commission shall also advise on community planning processes and the development of appropriate land development and zoning ordinances that fulfill the vision of the Township's Comprehensive Plan.

The Planning Commission shall exercise the following powers and be subject to the following duties:
1. 
Assist in the preparation, revision or amendment of the Township Comprehensive Plan, as set forth in the Municipalities Planning Code, and make recommendations to the Board of Supervisors on its adoption;
2. 
Maintain and keep on file records of its actions. All records and files of the Planning Commission shall be in the possession of the Board of Supervisors;
3. 
Assist in the preparation of and make recommendations to the Board of Supervisors concerning the adoption or amendment of the Official Map;
4. 
Assist in the preparation of and make recommendations to the Board of Supervisors concerning the adoption or amendment of the Township's Zoning, Subdivision and Land Development Ordinances;
5. 
Promote public interest in, and understanding of, the Township Comprehensive Plan and any other community planning efforts;
6. 
Advertise and conduct public meetings in accordance with the requirements of the Municipalities Planning Code;
7. 
Request from other departments and agencies of the Township such reasonably available information as the Commission may need to undertake its duties as set forth in this subpart;
8. 
In the performance of its functions, enter upon any land to make examinations and surveys with the consent of the land owner;
9. 
Review the Zoning Ordinance, Subdivision and Land Development Ordinance, Official Map, provisions for planned residential development, and such other ordinances and regulations governing the development of land no less frequently than it reviews the Comprehensive Plan;
10. 
Review land development, subdivision, and zoning applications;
11. 
Review such land development, subdivision, and zoning applications as may be referred to the Planning Commission by the Township; and
12. 
Do such other acts or make such studies as may be necessary to fulfill the duties and obligations imposed by the Board of Supervisors.

1. 
The Planning Commission may, with the consent of the Board of Supervisors, accept and utilize any funds, personnel or other assistance made available by the County, the Commonwealth, or the federal government, or any of their agencies, or from private sources. The Board of Supervisors may enter into agreements or contracts regarding the acceptance or utilization of the funds or assistance in accordance with the governmental procedures of the Township.
2. 
Act No. 247, known as the "Pennsylvania Municipalities Planning Code," 53 P.S. § 10101 et seq., is incorporated herein, to the extent it is not inconsistent with this subpart.
