The Township Supervisors herewith formally recognize the following
volunteer fire companies to provide firefighting service within the
Township: North Fayette Fire Department, Oakdale Volunteer Fire Department,
Sturgeon Volunteer Fire Department, Imperial Volunteer Fire Department
and McDonald Volunteer Fire Department.

The Township Supervisors herewith formally establish the current
fire zones and the fire companies which service them as delineated
in the map located in the North Fayette Township Police Department
Radio Dispatch Office as the official fire zones of the Township and
the fire companies which service the individual zones.

The Township Supervisors retain the exclusive right to change
the zones and/or the fire companies servicing the zones by changing
the map referred to above.

The fire companies recognized by the Township as aforesaid shall
continue to provide such services to the Township as have been and
will be necessary for the protection or property and persons situated
therein within their particular zones as designated by the Township
Board of Supervisors.

In the event that there are any conflicts between the respective
volunteer fire departments concerning the precise location of these
fire zones, inquiries or questions should be directed to the North
Fayette Township Public Safety Director.

The volunteer fire departments referred to above may only solicit
funds for their operations from within their respective designated
zones.

Each fire company must provide to North Fayette Township's Public
Safety Director an annual summary of the fire department calls for
service on or before April 30 for the proceeding year. Those statistics
will be utilized by the Township to determine the level, if any, of
contribution by the Township for continued service.

The aforementioned recognized companies may also provide nonemergency
and public service functions such as and by way of example and not
of limitation, removing water from property after storms and assisting
in the removal, abatement and prevention of damage or injury to persons
or property, whether through natural causes or a man-made situation
within their respective zones.

Companies may conduct and participate in such training activities
and drills within or outside the Township as may be deemed necessary
by the officers of the company to maintain proficiency in providing
service.

Due to
the costs incurred by the North Fayette Township Volunteer Fire Department,
in the event said Volunteer Fire Department incurs costs and/or expenses
associated with responding to a call, fees can be assessed as set
forth via resolution. Said fees can be amended from time to time via
resolution.

It is acknowledged
that the North Fayette Township Volunteer Fire Department uses a third-party
entity for services associated with calls. Said use of a third-party
service shall not affect the North Fayette Township Volunteer Fire
Department's ability to charge for costs and/or recoup the same. It
is understood and acknowledged that the North Fayette Township Volunteer
Fire Department may charge individuals for services associated with
responding to calls.

Due to
the growing number of false emergency alarms being responded to by
the North Fayette Township Volunteer Fire Department, the Township
herein encourages the use of appropriate alarm installation and maintenance
practices to prevent or minimize false alarms that require the response
of the North Fayette Township Volunteer Fire Department.
2.
FALSE EMERGENCY ALARM
Definitions.
As used in this section, the following terms shall have the meanings
indicated:
Any signal actuated by an emergency alarm to which the North
Fayette Township Volunteer Fire Department responds, which is not
the result of fire or other actual emergency, and not caused by an
extraordinary act of nature.

The principal
owner, operator, tenant, or other individual responsible for the facility
from which a false emergency alarm emanated shall pay to the North
Fayette Township Volunteer Fire Department a charge for false emergency
alarms, as required by this section, to which the North Fayette Township
Volunteer Fire Department responds, in each calendar year, as specified
in the fee resolution.

The following
schedule of notices, warnings, penalties, and costs shall be assessed
by the North Fayette Township Volunteer Fire Department, to the owners
and/or operators of emergency alarm systems from false emergency alarms
transmitted to the North Fayette Township Volunteer Fire Department
within any continuous twelve-month period, beginning with the first
false emergency alarm.
A.
The first
false emergency alarm results in a written notification by the Fire
Chief informing the owner or operator of the alarm system of the provisions
of this section.
B.
The second
false emergency alarm results in a written warning informing the owner
or operator of the alarm system of the provisions of this section
and the occurrence of a second violation.
C.
The third
false emergency alarm results in a written warning informing the owner
or operator of the alarm system of the provisions of this section
and the occurrence of a third violation.
D.
The fourth
false emergency alarm and every subsequent false emergency alarm will
result in a fine, as set forth in the Townships' fee resolution.
5.
Discretion.
A.
The Fire
Code Official and Fire Chief have reasonable discretion in regard
to determining a violation of the within section. Said discretion
is based on bad weather, construction, alarm service repairs, and/or
other circumstances that are not within the control of the property
owner or occupant.
6.
A false
alarm fine shall be due and payable to the North Fayette Township
Volunteer Fire Department 30 days from the date of notice of the fine.
If the amount is not paid within the thirty-day period, a certified
letter shall be sent to the principal owner, operator, tenant, or
other individual responsible for the alarm system of the alarmed facility
demanding payment within 30 days. If payment is still not made, the
Fire Code Official, Fire Chief or Law Enforcement Official will file
a citation with the district judge.

Posts, fences, structures, vehicles, growth, shrubs, trees or
plants of any kind, trash, storage, snow and other materials or objects
of any kind or of any nature whatsoever shall not be placed or kept
near fire hydrants, fire department inlet connections or fire protection
system control valves in a manner that would prevent such equipment
or fire hydrants from being immediately discernible and accessible.
The fire department shall not be deterred or hindered from gaining
immediate access to fire protection equipment or fire hydrants.

A three-foot clear space shall be maintained around the circumference
of fire hydrants except as otherwise required or approved. The owner,
tenant or other occupant of any premises within the Township shall
clear snow, growth, posts, fences, debris, trash and any other material
of any manner or nature whatsoever a sufficient distance to allow
access to and connection to said fire hydrant by the equipment of
the fire company serving said area or responding to any emergency,
but in any event, not less than three feet.

The Chief of Police of the Township of North Fayette is hereby empowered to enforce the within Part. Upon the determination that any fire hydrant is obstructed in any manner as set forth in §§ 7-201 and 7-202 above, the Chief of Police shall issue a written warning to the owners of said property in violation of this Part directing them to remove said obstruction, weeds, or snow from said fire hydrant within 72 hours of said notice, or they shall be in violation of this Part and be subject to the penalties set forth herein.

In the event the Chief of Police of North Fayette Township determines that said obstructions under §§ 7-201 or 7-202 are of such a nature as to cause immediate danger to the public safety, then, and in that event, the Township of North Fayette may enter upon said property, remove the obstructions and proceed to collect the cost of same by liening the real estate of the individuals involved in accordance with the appropriate statutes governing municipal liens.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a magisterial district judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.
