The Board of Supervisors hereby adopts the application form
for approval of a liquor license transfer as attached hereto as Exhibit
13-3-A.

The Board of Supervisors hereby generally establishes the following
procedures for the review of the above-listed application and public
hearing required by commonwealth statute:
A.
Upon receipt of the original application for liquor license transfer
approval, and the applicable filing fee for the same, the Township
Manager shall review the application for completeness.
(1)
In the event that preliminary review of the application indicates
that it is incomplete or fails to provide necessary information, the
Township Manager shall, within one week of the date of receipt, send
a rejection notice stating the reasons for rejection and requiring
that the application either be completed and resubmitted for approval
within 14 days, or the rejection letter will constitute a final rejection
of this application by the Township Manager.

Upon receipt of a complete application, the Township Manager
shall set a date for public hearing, to be held before the Township
Board of Supervisors. The hearing will be held within 30 days of the
date of receipt of the completed application. The Township Manager
will then prepare legal notice advertisements for the public hearing.
The advertisement shall list the purpose of the hearing, the name
and location of the applicant business, and the date, time and location
of the public hearing. The Township Manager will submit same to the
local paper in which such legal advertisement is customarily done
by the Township. The legal advertisement will be published once in
the above referenced publication, in accordance with Sunshine Law
requirements. Additionally, the Township Manager shall send written
letters via regular mail notifying all residents and business owners,
who live or have businesses within 500 feet of the applicant's property
and/or establishment of the public hearing.
B.
The public hearing shall be held upon the date, at the time and location
provided in the legal notice to the community.
(1)
At the public hearing, the applicant shall provide testimony
relating to the effect of the license transfer approval upon the health,
safety, welfare and morals of the Township, whether or not the Township
is permitted or required to accept such type of license transfer,
and if the transfer of an intermunicipal license, the actual identity
of the transferors and details of the transfer. No information relating
to the financial matter involved in this transaction shall be required.

Members of the community and general public shall also be permitted to testify regarding the issues listed in Subsection 1B(1).
(3)
Board of Supervisors, the Township Manager, Treasurer, Solicitor,
and Engineer will be permitted to ask questions and/or examine the
witnesses relevant to issues material to the application approval.
(4)
The Township shall then render a decision in the form of a resolution
on whether or not they approve the application, which resolution shall
be provided to the applicant within 45 days of the receipt of a completed
application.

The Board of Supervisors hereby generally adopts and establishes
an application fee to cover the costs associated with fees for the
services to be performed under the provisions of the resolution, in
the initial amount to be established, from time to time, by resolution
of the Board of Supervisors. The Township of North Fayette may, from
time to time hereafter, amend the fees for the services to be performed
under the provisions of this Part, which fee(s), if any, shall be
adopted by resolution of the Board of Supervisors.

In addition to any application fees, applicant shall also be
required to pay for all costs of legal advertising associated with
all public hearing(s) scheduled pursuant to this application.
