A certain document, a copy of which is on file in the office
of the Secretary of the Township of Collier, being marked and designated
as the "2009 International Fire Code," be and is hereby adopted as
the Fire Code of the Township of Collier pursuant to the First Class
Township Code, § 1502I(d), to establish minimum firesafety
requirements for new and existing buildings, structures and property
as herein provided, and subject to any amendments contained herein
or that may be adopted from time to time; and each and all of the
regulations, provisions, penalties, conditions and terms of said 2009
International Fire Code are hereby referred to, adopted and made a
part hereof as if fully set out in this Part, with the additions,
insertions, deletions and amendments, if any, prescribed in this Part.

The 2009 International Fire Code is amended and revised, with additions,
deletions and changes noted in the following respects:
A.
Section 101.1, page 1, second line. Insert "Township of Collier"
in space provided.
B.
Section 103, "Department of Fire Prevention." Delete the reference
to "Department of Fire Prevention" and replace the deleted reference
with a reference to "Chief Building and Fire Code Official."

Revise § 103.1 to read:
§ 103.1. General. The official in charge
of enforcing this Part shall be the Chief Building and Fire Code Official
(hereinafter, Fire Code Official). The Fire Code Official may be an
individual or a corporation or other organization providing International
Fire Code enforcement services. This Part may also be enforced by
any other person or entity designated by the Collier Township Board
of Commissioners by resolution.
C.
Section 109, "Violations." Revise Subsection 109.3, "Violation Penalties,"
to read in its entirety as follows:
§ 109.3. Violation Penalties. Any person,
firm or corporation who shall violate any provision of this code shall,
upon conviction thereof, be subject to a fine not more than $1,000.
Each day that a violation continues shall constitute a separate offense.
D.
Section 108, "Board of Appeals."
(1)
Revise Section 108 to read, in its entirety, as follows:
§ 108.1. Appeals Board. Any person aggrieved
by a decision of the Fire Code Official or a notice or order issued
under this code shall have the right to appeal, within 20 days after
the date of the decision, notice or order appealed from, to the Collier
Township Construction Code Board of Appeals ("Board"), which Board
shall have jurisdiction to hear and rule on appeals filed hereunder.
Such appeal shall be filed in writing, shall state the grounds for
appeal, shall be accompanied by the required appeal fee, $50 or such
other fee as set under the Township of Collier Fee Schedule by resolution,
and shall be processed and heard in accordance with the Local Agency
Law and the procedural requirements of the Township of Collier Construction
Code Board of Appeals Rules of Procedure and Operation; provided,
further, that any substantive requirements of such Rules of Procedure
and Operation applicable only to appeals under the Uniform Construction
Code shall not apply to appeals under the International Fire Code.
All advertising and court reporter costs resulting from the appeal
will be paid by the appellant prior to commencement of the appeal
hearing.
(2)
Delete Section 108.3, Qualifications, in its entirety.
E.
§ 111.4, Failure to Comply, is revised by inserting dollar
amounts therein such that the last clause shall read ". . . shall
be liable to a fine of not less than $1,000 or more than $1,000."
F.
A new Section 907.10, Smoke Alarms, shall be added to read as follows:
§ 907.10. Smoke Alarms. The following
regulations shall apply with respect to smoke alarms in addition to
any other provisions of this code and shall be controlling to the
extent inconsistent with such other provisions:

907.10.1. Installation Required. Smoke alarms shall
be installed in all NEW OR EXISING Group A, B, E, F, H, I, M, and
S occupancies.

907.10.2. Power Source.

907.10.2.1. In Group R occupancies and Group A, B, E, F, H,
I, M, and S occupancies, single-station smoke alarms shall receive
their primary power from the building wiring, provided that such wiring
is served from a commercial source and shall be equipped with a battery
backup. Smoke alarms shall emit a signal when the batteries are low.
Wiring shall be permanent and without a disconnecting switch other
than as required for overcurrent protection.

907.10.2.2. Exception: Smoke alarms are permitted
to be solely battery-operated in buildings where no construction is
taking place, buildings that are not serviced from a commercial power
source and in existing areas of buildings undergoing alterations or
repairs that do not result in the removal of interior wall or ceiling
finishes exposing the structure, unless there is an attic, crawl space
or basement available which could provide access for building wiring
without the removal of interior finishes.

907.10.3. Interconnection.

907.10.3.1. Where more than one smoke alarm is required to be
installed in Group A, B, E, F, H, I, M, and S occupancies, the smoke
alarms shall be interconnected in such a manner that the activation
of one alarm will activate all of the alarms in the individual unit.
The alarm shall be clearly audible in all areas over background noise
levels with all intervening doors closed.

907.10.3.2. Exceptions:

Interconnection is not required in buildings which are not undergoing
alterations, repairs or construction of any kind.

Smoke alarms in existing areas are not required to be interconnected
where alterations or repairs do not result in the removal of interior
wall or ceiling finishes exposing the structure, unless there is an
attic, crawl space or basement available which could provide access
for interconnection without the removal of interior finishes.
