That no person shall engage in, carry on or conduct, within the corporate limits of the City of Bel-Nor the business of selling motor fuel, either retail or wholesale, without having first obtained a license therefor from the City Clerk for each place of business in said City at which it is proposed to conduct such business, which license shall be kept available for inspection at the place in said City at which such business is conducted.

A. 
Applications for said license shall be made to the City Clerk on forms prescribed by him/her and approved by the Board of Aldermen and shall contain, inter alia, the following information and particulars:
1. 
Name of person, firm or corporation applying for such license.
2. 
Residence address of person or members of firm, or, if a corporation, the name of its three (3) principal officers and the location of its principal office.
3. 
Address or location within the City at which said business is to be conducted.
4. 
A statement by the applicant or his/her or its duly authorized agent that the applicant will at all times well and truly conform to all of the provisions of this Chapter.
5. 
Such application shall be duly sworn to by the applicant or his/her or its duly authorized agent.

On presentation to him/her of such application duly and properly executed, the City Clerk shall issue to such applicant a license, the form of which is to be prescribed by him/her and approved by the Board of Aldermen, to engage in the business as provided for in Section 625.010, for a period of one (1) year from the date thereof and shall be renewable from year to year. Such license shall not be transferable, and any change in address from which such business is conducted must be reported at once to the Clerk.

On the 10th day of each month, unless such day be a Sunday or a legal holiday, in which event on the succeeding day, commencing with the 10th day of May 1948 (unless such license be secured subsequent to May 10, 1948, in which event, commencing on the 10th of the month subsequent to the month in which such license was secured), each holder of a license under this Chapter shall report under oath to the Clerk on forms to be furnished by him/her and approved by the Board of Aldermen the number of gallons of motor fuel received and sold by such licensee during the period dating from the first day to Midnight of the last day of the preceding month, and shall accompany with his/her report as aforesaid, as and for a monthly license fee hereunder, a sum equal to one cent ($0.01) per gallon for each and every gallon of motor fuel sold by him/her, either retail or wholesale, during the preceding month, and shall demand and receive from the Clerk a receipt for said report and remittance.

Failure of any licensee to report and to remit in manner and form as provided in the previous Section shall, ipso facto, revoke, nullify and cancel the licensee's license to conduct or engage in the sale of motor fuel, either wholesale or retail, and, in the event he/she shall continue to engage in, conduct or carry on within the corporate limits of the City of Bel-Nor the business of selling motor fuel, retail or wholesale, without so reporting and remitting, shall subject him/her to the same penalties hereinafter provided for failure to secure a license under the terms of this Chapter as provided in Section 625.070(B) hereof. Said licensee shall, at all time, keep his/her last receipt available for inspection at the place in said City at which such business is conducted.

The licensee shall, at all times, keep available for inspection at his/her place of business a set of books in which shall be recorded and in which he/she shall enter the number of gallons of motor fuel received by him/her, the number of gallons sold by him/her, and the dates on which said motor fuels were received and sold. The Clerk or the Chief of Police or one of his/her deputies, on the order of the City Clerk shall have the right at all reasonable hours to inspect said books on demand for the purpose of determining the truth or falsity of any report submitted to the Clerk by said licensee. Failure of any licensee to keep books as herein provided shall be deemed to be an ordinance violation and, on conviction thereof, the licensee shall be fined as set out in Section 100.220 and his/her license shall be revoked.

A. 
Any licensee who shall refuse to permit such inspection of books as provided for in the preceding Section or who shall wilfully submit a false or inaccurate report to the Clerk shall be deemed guilty of an ordinance violation and, on conviction thereof, shall be subject to a fine as set out in Section 100.220, and his/her license shall stand revoked at the discretion of the Mayor until the terms of this Chapter are complied with.
B. 
Failure on the part of any person engaged in, carrying on or conducting within the corporate limits of the City of Bel-Nor the business of selling motor fuel, either retail or wholesale, to first secure a license as herein provided shall be construed to be an ordinance violation, and on conviction thereof, shall subject such person to a fine as set out in Section 100.220, and each day that such person shall carry on or conduct such business without a license, shall constitute a separate and distinct offense.

For the purpose of this Chapter, the masculine gender shall be construed to include the feminine gender, the singular number shall be construed to include the plural number and the following words shall have the prescribed meanings:
CLERK
The City Clerk or any deputy or inspector duly appointed by him/her.
MOTOR FUEL
Shall be construed to include every volatile, inflammable liquid ordinarily, practically or commercially usable in internal combustion engines for the generation of power. It shall not be construed to include kerosene oil or kerosene distillate.
PERSON OR PERSONS
Any natural person, group of persons, firm or corporation, or their or its agent or agents, servant or servants.
