BICYCLE
Includes every device propelled by human power upon which any person might ride, having two tandem wheels, either one or both of which is of a diameter of 20 inches or more.
LICENSE
Shall be a metallic plate having numbers stamped thereon in numerical order and indicating the period for which the same is issued.
PERSON
Includes any individual person, firm, association or corporation.

It shall be unlawful for any person who is a resident of the Borough of Stroudsburg to operate a bicycle upon any of the public streets, alleys or highways within the Borough of Stroudsburg without obtaining a license as herein provided through the Stroud Area Regional Police Department.

All persons who are residents of the Borough of Stroudsburg owning or operating bicycles within the said Borough shall make an application for a bicycle license plate upon the form provided by the Borough of Stroudsburg and issued through the Stroud Area Regional Police Department under the supervision of the Mayor of the Borough of Stroudsburg, and shall pay therefor a biennial license fee of $0.50 for each biennial period or part thereof for which the license plate or renewal is issued.

The Borough shall provide metallic license plates, together with ownership certificates, both of which shall be numbered or have numbers stamped thereon in numerical order, and shall indicate the period for which the same are issued. The Chief of Police, under the supervision of the Mayor of the Borough of Stroudsburg, upon receiving proper executed application, is authorized to issue a license plate and certificate, which shall be effective during the remainder of the period in which the same is issued and shall expire on May 31 of each odd-numbered year.

The Stroud Area Regional Police Department, under the supervision of the Mayor, shall keep a record of each license issued, showing thereon the date of issuance, the name of the person to whom issued, and the identification number of the bicycle for which issued, together with a record of the fees collected for such licenses.

The license plate issued shall be attached to the frame of the bicycle for which it is issued so that the same is visible at all times and shall remain so attached during the term for which the license is issued.

Upon the expiration of the bicycle license or upon the loss of any bicycle license, the same may be renewed or replaced upon a proper application and payment of the fees set forth hereinabove, through the Police Department under the supervision of the Mayor of the Borough of Stroudsburg.

All persons, residents of the Borough of Stroudsburg, making application for a license for a bicycle shall have the bicycle inspected by the Stroud Area Regional Police Department, and a license shall be refused to any person making an application therefor for a bicycle which the Police Department deems to be in an unsafe mechanical condition and not equipped with a proper braking device.

If any person to whom a license has been issued for a bicycle sells or transfers said bicycle, the license plate shall be removed and surrendered to the Stroud Area Regional Police Department or may, upon proper application, without any charge or an additional fee, have the said license transferred to another bicycle owned by the same person.

No person shall lend any bicycle or offer the bicycle for rent unless the same is duly licensed, the plate attached to said bicycle, and the bicycle equipped in accordance with the provisions of this Part 1.

All persons operating bicycles upon any public street, alley or highway within the Borough of Stroudsburg shall be subject to the provisions of the traffic regulations of the Borough of Stroudsburg as the same are applicable to the operator of any motor vehicle, except as otherwise herein provided, and all such persons operating bicycles within the Borough of Stroudsburg shall obey instructions of official traffic signals, signs and other traffic control devices, unless otherwise provided herein, and shall be subject to the following regulations:
1. 
All persons operating a bicycle shall ride only upon the regular seat provided thereon and shall not permit any other person to ride said bicycle at the same time, except upon a regular seat provided in tandem.
2. 
No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped.
3. 
No person shall operate a bicycle at any time unless both hands are upon the handlebars.
4. 
No person operating a bicycle shall carry any package, bundle or other article which in any way prevents the operator from keeping both hands upon the handlebars.
5. 
All persons operating bicycles upon any public street, alley or highway within the Borough of Stroudsburg shall operate said bicycle as close to the right-hand side of said street, alley or highway as practicable under the circumstances, exercising due care when passing standing vehicles or passing one proceeding in the same direction.
6. 
All operators of bicycles when emerging from an alley, driveway or hidden entrance shall, upon approaching a sidewalk or crosswalk, yield the right-of-way to all pedestrian traffic, and upon entering the traveled portion of the street, alley or highway, shall yield the right-of-way to all vehicles approaching thereon.
7. 
All persons operating bicycles upon any public street, alley or highway within the Borough of Stroudsburg shall not ride with more than two bicycles abreast at any one time, except in such areas or upon such portions of said highways, streets or alleys as may be set aside for the exclusive use and operation of bicycles.
8. 
No person shall ride a bicycle upon a sidewalk in the Borough of Stroudsburg.

All bicycles owned and operated by residents of the Borough of Stroudsburg, before a license can be issued therefor upon application, shall have said bicycle equipped with a bell or other signaling device capable of rendering a signal audible for a distance of at least 100 feet, and all bicycles must be equipped with a braking device enabling the operator thereof to make or cause the wheel of said bicycle to skid on a dry, level pavement.

It shall be unlawful for any person to remove, destroy, mutilate or in any way alter or change the identification number on any bicycle frame of any licensed bicycle under the terms of this Part 1, and further it shall be unlawful for any person to remove, destroy, mutilate, alter or change any license plate or certificate during the term for which said plate and certificate is issued; provided, however, that the Police Department, under the supervision of the Mayor of the Borough of Stroudsburg, may cause to be stamped upon bicycles identifying numbers if any such bicycles have no numbers of identification.

Any person violating any of the provisions of this Part may, in lieu of conviction thereof, have the license plate and certificate suspended for a period not to exceed 30 days. In such event, the license plate shall be removed by the Police Department under the supervision of the Mayor of the Borough of Stroudsburg, and subsequent operation of said bicycle during the period of said suspension shall constitute a violation of this Part 1.

Any person violating any of the provisions of this Part shall, upon conviction thereof before any District Justice, be sentenced to pay a fine of not more than $100 and costs of prosecution.

ROLLER SKATES
Any footwear or other device that can be attached to the foot containing wheels allowing the wearer to propel himself or herself along a surface. As used in this Part, roller skates include roller blades and in-line skates.
SCOOTER
Every device propelled by human power, having one or more wheels affixed to a board or platform upon which any person might ride, stand, or sit and having handlebars or a similar device designed for steering.
SKATEBOARD
Every device propelled by human power, having one or more wheels affixed to a board or platform upon which any person might ride, stand or sit.

All persons operating skateboards, scooters, roller skates and other similar devices on any public street, alley, highway, sidewalk, public parking lot or Borough property within the Borough of Stroudsburg shall be subject to the following regulations:
1. 
No person shall ride or operate roller skates, a skateboard, scooter or other similar device upon any public street, alley, highway, or public parking lot within the Borough of Stroudsburg.
2. 
No person shall ride or operate roller skates, a skateboard, scooter, or other similar device upon any sidewalk located within the following area bounded as follows:
A. 
Ninth Street on the west including the sidewalk on the west side of Ninth Street, east to the Interborough Bridge, the south side of Sarah Street between Fifth and Ninth; Sarah Street Extension and McConnell Street on the north including the sidewalks located on the north side thereof; south to the sidewalk on the south side of Main Street.
3. 
No person shall ride or operate roller skates, a skateboard, scooter or other similar device upon any sidewalk located adjacent to any other street, alley or highway located in the Borough of Stroudsburg except during daylight hours.
4. 
No person shall operate roller skates or a skateboard while hanging onto another vehicle (including a bicycle or another skateboard or a motorized vehicle).
5. 
No skateboard ramp shall be constructed, used or maintained on any sidewalk.

All operators of roller skates, skateboards, scooters and other similar devices shall yield the right-of-way to pedestrian traffic by not operating any skateboard within 20 feet of any pedestrian and shall otherwise operate such devices in a reasonable and safe manner.

Any person violating any provision of this Part 2 shall, upon conviction before a District Justice, be subject to a fine not to exceed $100, plus court costs. The Police Department shall have the right to confiscate the skateboard, scooter, and/or roller skates of any person violating this Part 2, which equipment shall be retained as evidence pending conclusion of disposition of the violation.
