The Board of Township Supervisors hereby signifies its intention and desire to organize an authority under the provisions of the Municipality Authorities Act of 1945, as amended.[1]

The Chairman and the Secretary of the Board of Township Supervisors are hereby authorized and directed to execute on behalf of Scott Township Articles of Incorporation for the Authority in substantially the following form.[1]

The Chairman and the Secretary of the Board of Township Supervisors are hereby directed to cause a notice of the proposed filing of the above Articles of Incorporation to be published once in a newspaper of general circulation in Columbia County, Pennsylvania, as required by the Municipality Authorities Act of 1945, as amended.[1]

The Chairman and the Secretary of the Board of Township Supervisors are directed to file said Articles of Incorporation, together with the necessary proofs of publication, with the Secretary of the Commonwealth and to do all other acts and things necessary or appropriate to effect the incorporation of Scott Township Authority.
The following named persons be and they hereby are appointed as the first members of the Board of the Authority, whose terms of office shall commence on the date of appointment and shall be computed from January 1 next succeeding the date of incorporation.[1]

The project which shall first be undertaken by the Authority is to acquire, hold, construct, improve, maintain, operate, own or lease, either as lessor or as lessee, sewers, sewer systems and sewage treatment works for Scott Township and for such other territory as it may be authorized to serve.

The Authority Board members shall be entitled to received $25 for one meeting per month, provided that, in order to be entitled to payment, a Board member must attend one regular public meeting of the Authority during any given month. Compensation provided for hereunder shall be paid out of the Authority's funds.

This Township does grant to the Authority, its successors and assigns all easements, rights-of-way and other rights and privileges necessary and desirable in, along, over and under streets, roads, lanes, courts, culs-de-sac, alleys, public ways, public squares and other properties of this Township, together with free ingress, egress and regress therein and thereto, along with other persons having interests or rights therein, for use in connection with construction, replacing, repairing, altering, extending, improving, operating and maintaining the sewer system as the same shall exist from time to time.
The rights and privileges granted to the Authority under § 5-7 shall be exercised by the Authority under and subject to such reasonable rules and regulations as shall be adopted and specified, from time to time, by resolution or ordinance of this Township, and this Township does reserve the right to adopt and specify, from time to time, such reasonable rules and regulations in connection with exercise by the Authority of such rights and privileges.
It is declared that enactment of this article is necessary for the protection, benefit and preservation of the health, safety and welfare of the inhabitants of this Township.
