The Township hereby adopts, for the purpose of establishing rules and regulations for the maintenance of all structures, including administration, enforcement and penalties, the property maintenance code known as the "BOCA National Property Maintenance Code, Edition, 2015," as published by the Building Officials and Code Administrators International, Inc., save and except such portions as are hereinafter deleted, modified or amended, of which three copies have been and are now filed in the office of the Township Secretary, and the same are hereby adopted and incorporated as fully as if set out at length herein. From the date on which this Part shall take effect, the provisions thereof shall be controlling in the maintenance of all structures, and in all other subjects therein contained, within the corporate limits of the Township.

The Property Maintenance Code hereby adopted is amended as follows:
A. 
Section 101.1, "Title," is amended to read:
"§ 101.1. Title. These regulations shall be known as the Property Maintenance Code of the Township, hereinafter referred to as 'this code.'"
B. 
Section 103.5, "Fees," is amended to read:
"§ 103.5. Fees.
"The fees for activities and services performed by the Township in carrying out its responsibilities under this Code shall be as enacted, from time to time, by the Board of Commissioners by resolution."
C. 
Section 112.4, "Failure to Comply," is amended to provide:
"§ 112.4. Failure to Comply.
"Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, upon conviction thereof, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense."
D. 
Section 302.4. Insert: "10 inches."
E. 
Section 304.12, "Insect Screens," is amended to read:
"§ 304.12. Insect Screens.
(1)
During the period from April 1 to October 30, every door, window and other outside opening utilized or required for ventilation purposes serving any structure containing habitable rooms, food preparation areas, food service areas, or any areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch and every swinging door shall have a self-closing device in good working condition.
(2)
Exception. Screen doors shall not be required for outswinging doors or other types of openings which make screening impractical, provided other approved means, such as air curtains or insect repellent fans are employed."
F. 
Section 602.2, "Residential Buildings," is amended to read:
"§ 602.2. Residential Buildings. Every dwelling shall be provided with heating facilities capable of maintaining a room temperature of 65° F. (18° C.) in all habitable rooms, bathrooms and toilet rooms based on the outside design temperature required for the locality by the mechanical code listed in Chapter 8."
G. 
Section 602.3, "Nonresidential Structures," is amended to read:
"§ 602.3. Nonresidential Structures.
(1)
Every enclosed occupied work space shall be supplied with sufficient heat during the period from October 1 to May 1 to maintain a temperature of not less than 65° F. (18° C.) during all working hours.
(2)
Exceptions.
(a)
Processing, storage and operation areas that require cooling or special temperature conditions.
(b)
Areas in which persons are primarily engaged in vigorous physical activities."

In all matters that are regulated by the law of the Commonwealth of Pennsylvania or by regulations of departments or agencies of the Commonwealth promulgated by authority of law, such laws or regulations, or other ordinances of the Township, as the case may be, shall control where the requirements thereof are the same as or in excess of the provisions of this Part. The code shall control in all cases where the state requirements, or the requirements of other ordinances of this Township, are not as strict as those contained in this Part.

The provisions of this Part so far as they are the same as those of ordinances and/or codes in force immediately prior to the enactment of this Part, are intended as a continuation of such ordinances and codes and not as new enactments. The provisions of this Part shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any right or penalty or to punish any offense under the authority of any of the repealed ordinances.
