A. Whoever
shall, within the limits of this City, dig, make or cause to be dug
or made any excavation in any street, avenue, alley or other public
place, or any place immediately adjoining the same, and shall fail
or neglect to place or cause to be placed around and along such excavation
such barriers as shall be sufficient to prevent persons, animals,
or vehicles from falling into such excavations, or shall fail to keep
or fail to be kept a light burning during the night, at each end of
such excavation, shall be deemed guilty of an ordinance violation.
B. Guarding
Excavations — Destroying, Etc. Barriers, Guards. Any person
who shall unlawfully remove, destroy or render insecure, any barrier
or guard erected about any excavation, as required by the ordinances
of the City, or who shall extinguish, destroy or remove any light
or lamp placed at such excavation, or shall aid in or counsel any
such removal or destruction, shall be deemed guilty of an ordinance
violation.

A. Permit
Required. Hereafter it shall be unlawful for any person, firm or corporation
to tear up, dig into or disturb the pavement of any street, road or
alley of this City, without first obtaining a permit to do so from
the City Clerk, which permit shall be countersigned by the City Manager
or his/her designee.
1. Required Fee For Cutting Street, Etc. In order to obtain a permit
for cutting, tearing up, digging or otherwise disturbing the pavement
of any street, road or alley as set forth above, the applicant shall
pay to the City a minimum fee of four hundred dollars ($400.00) plus
the City's actual cost of labor and materials to perform and/or repair
said street cut.
B. Bond.
Said person, firm or corporation taking out such permit shall enter
into a bond to the City in twice the amount which the City Manager
shall compute will be sufficient to guarantee the expense of replacing
said pavement in as good condition as it was at the beginning of the
said work.
C. Failure To Comply With Subsection
(A) Or (B) Herein. Any person who shall disturb, tear up or in any manner interfere with the surface of any street, without having complied with the two (2) preceding Sections, shall be deemed guilty of an ordinance violation.

Whoever shall, within the limits of this City, keep or leave
open, or permit to be kept open, the grating of any vault, or the
door to any cellar way, on any sidewalk attached to or belonging to
any premises owned, occupied or controlled by him/her, or shall permit
any vault, grating or cellar door to become and remain in such insecure
condition as to endanger persons or animals falling into such vault
or cellar, shall be deemed guilty of an ordinance violation.

All excavations for building sewer installation shall be adequately
guarded with barricades and lights so as to protect the public from
hazard. Streets, sidewalks, parkways, and other public property disturbed
in the course of the work shall be restored in a manner satisfactory
to the City.
