There is hereby created and established an Environmental Advisory
Council pursuant to Act No. 177 of 1996, P.L. 1158, 53 Pa.C.S.A. § 2321
et seq., as amended, to advise the Planning Commission, Board of Supervisors
and other Township boards on matters dealing with protection, conservation,
management, promotion and use of natural resources including air,
land and water resources located within its territorial limits.

1. The Environmental Advisory Council shall be composed of not less
than three nor more than seven members, each of whom must be residents
of the Township. The Board of Supervisors shall appoint members to
the Environmental Advisory Council.
2. Council members shall serve terms of three years, except that the
initial appointments shall be staggered so that the terms of approximately
one-third of the membership shall expire each year.
3. Council members shall receive no compensation for their services,
but shall be reimbursed for the expenses actually and necessarily
incurred by them in the performance of their duties, provided that
such expenses are approved in advance by the Township Manager.

The Board of Supervisors shall designate a Chairman of the Environmental
Advisory Council.

The Advisory Council shall meet at least quarterly.

1. The Environmental Advisory Council shall have the power to: identify
environmental problems and recommend plans and programs to the appropriate
Township agencies for promotion and conservation of natural resources
and for protection and improvement of the quality of the environment
within its territorial limits; make recommendations as to the possible
use of open land areas of the Township within its territorial limits;
promote a community environmental program; keep an index of all open
areas, publicly or privately owned, including but not limited to flood-prone
areas, swamps and other unique natural areas, for the purpose of obtaining
information on the proper use of such area; and advise the appropriate
local governmental agencies including, but not limited to, the Planning
Commission, and the Board of Supervisors on the acquisition of property,
both real and personal, by gift, purchase, grant, bequest, easement,
devise or lease in matters dealing with the purposes of this Part.
2. The Environmental Advisory Council shall not exercise any powers
or perform any duties which by law are conferred upon state agencies.

The Environmental Advisory Council shall keep records of its
meetings and activities and shall make quarterly reports which shall
be submitted to the Board of Supervisors and printed in the annual
municipal report or, if none, otherwise made known and available.

The Board of Supervisors, by establishing the Environmental
Advisory Council, may appropriate funds for the expenses incurred
by the Environmental Advisory Council. Appropriations may be expended
for such administrative, clerical, printing and legal services as
may, from time to time, be required and as shall be within the limit
of funds appropriated to the Environmental Advisory Council. The whole
or any part of any funds so appropriated in any year may be placed
in a conservation fund, allowed to accumulate from year to year, or
be expended in any year.

Nothing in this Part shall be construed to require the Board
of Supervisors to abolish any existing commissions with a related
responsibility or to prevent its establishment.
