The MTMA may decline to issue or reissue a wastewater discharge
permit to any industrial user which has failed to comply with any
provision of this Part and/or pretreatment standard and/or requirement,
including the provisions of a previous wastewater discharge permit
or order issued hereunder, unless such industrial user first files
a satisfactory bond, payable to the MTMA, in a sum not to exceed a
value determined by the MTMA to be necessary to achieve consistent
compliance.

The MTMA may decline to issue or reissue a wastewater discharge
permit to any industrial user which has failed to comply with any
provision of this Part and/or pretreatment standard and/or requirement,
including the provisions of a previous wastewater discharge permit
or order issued hereunder, unless the industrial user first submits
proof that it has obtained financial assurances sufficient to restore
or repair damage to the POTW caused by its discharge.

Whenever an industrial user has violated or continues to violate
any provision of this Part and/or pretreatment standard and/or requirement,
including the provisions of a wastewater discharge permit or order
issued hereunder, water service to the industrial user may be severed.
Service will only recommence, at the industrial user's expense,
after it has satisfactorily demonstrated its ability to comply.

Any violation of a provision of this Part and/or pretreatment
standard and/or requirement, including the provisions of a wastewater
discharge permit or order issued hereunder, is hereby declared a public
nuisance and shall be corrected or abated as directed by the MTMA.
