There is hereby created a special revenue fund to be known as
the Drug Enforcement and Education Special Revenue Fund (the "fund")
to be administered pursuant to the terms of this chapter.
The purpose of the fund shall be to finance costs associated
with the administration of drug enforcement and education activities
by the Sheriff of Charles County, the State's Attorney of Charles
County and related agencies.

The first $250,000 received by Charles County in each year beginning
after June 30, 2013, from the forfeiture or sale of property seized
under Title 12 of the Criminal Procedure Article of the Annotated
Code of Maryland, as a result of the enforcement of laws relative
to controlled dangerous substances shall be allocated to the fund.

A.
Thirty
percent of the money in the fund shall be reserved for appropriation
to the State’s Attorney of Charles County for the purpose of
investigating and prosecuting narcotics and narcotics-related crimes.
Twenty percent of the money in the fund shall be reserved for appropriation
by Charles County for use in drug prevention, education, treatment
and enforcement programs. The remaining 50% of the money in the fund
shall be reserved for appropriation to the Sheriff of Charles County
for the purpose of:

Law
enforcement investigations;
(2)
Law
enforcement training;
(3)
Law
enforcement and detention facilities;
(4)
Law
enforcement equipment;
(5)
Law
enforcement travel and transportation;
(6)
Law
enforcement awards and memorials;
(7)
Drug
and gang education and awareness programs;
(8)
Matching
funds;
(9)
Pro
rata funding; and
(10)
Asset
accounting and tracking.
B.
Limitations
on the uses of the money as set forth in the Federal Guide to Equitable
Sharing for State and Local Enforcement Agencies shall apply to federal
shared funds in Charles County.
Moneys in the fund may only be expended as stipulated in this
chapter and shall not be a source of revenue to meet normal operating
expenses of any of the aforementioned agencies of government.
