The Township, a certified franchising authority shall, and does hereby,
adopt and agree to implement and administer such regulations as are
consistent with those regulations prescribed by the Federal Communications
Commission pursuant to the Cable Television Consumer Protection and
Competition Act, 47 U.S.C. § 543, as amended, including
and specifically incorporating those regulations established and published
in 47 CFR 76.33, the terms and conditions of which are incorporated
herein by reference, and as may be hereinafter amended, adopted or
revised.

The Board of Supervisors herein and hereby makes an initial finding
of lack of effective competition, as that phrase and term is defined
by the Act and the regulations adopted and promulgated pursuant thereto
with regard to the provisions of basic cable service by Suburban Cable
Television Company, Inc., within the Township of New Hanover.

The establishment and evaluation of any and all rates for the provision
of basic cable service provided by the Suburban Cable Television Company,
Inc., within the Township shall be subject to the procedural requirements
to provide formal notice to the public, provide an opportunity for
interested parties to make their views known, including receipt of
written submissions, to issue formal statements and a written decision
when such a decision on a rate matter is made and to permit petitions
for relief in accordance with the regulations prescribed by the Federal
Communications Commission.

Such modifications, revisions and enactments as may be approved and
established by the Federal Communications Commission implementing
the Cable Television Consumer Protection and Competition Act shall
be and are hereby incorporated as the applicable regulations for basic
cable service rates within the Township of New Hanover.
