Note: The following language taken from DEP's NPDES program and model NPDES ordinance is required to be incorporated into this chapter.
1. 
Any drain or conveyance, whether on the surface or subsurface, that allows any nonstormwater discharge, including sewage, process wastewater, and wash water, to enter the regulated small MS4 or to enter the surface waters of this commonwealth is prohibited.
2. 
No person shall allow, or cause to allow, discharges into a regulated small MS4 or to enter the surface waters of this commonwealth which are not composed entirely of stormwater, except: A) as provided in Subsection 3 below; and B) discharges allowed under a state or federal permit.
3. 
Discharges that are authorized unless they are determined by New Hanover Township to significantly contribute to pollution to a regulated small MS4 or to the surface waters of the commonwealth are:
A. 
Discharges or flows from firefighting activities.
B. 
Discharges from potable water sources, including dechlorinated water line and fire hydrant flushing if such discharges do not contain detectable concentrations of total residual chlorine (TRC).
C. 
Noncontaminated irrigation water, water from lawn maintenance, landscape drainage and flows from riparian habitats and wetlands.
D. 
Diverted stream flows and springs.
E. 
Noncontaminated HVAC condensation and water from geothermal systems.
F. 
Residential (i.e., not commercial) vehicle wash water where cleaning agents are not utilized.
G. 
Noncontaminated pumped groundwater and water from foundation and footing drains and crawl space pumps.
H. 
Noncontaminated hydrostatic test water discharges if such discharges do not contain detectable concentrations of TRC.
4. 
In the event that New Hanover Township or DEP determines that any of the discharges identified in Subsection 3 significantly contribute pollutants to a regulated small MS4 or to waters of the commonwealth, New Hanover Township or DEP will notify the responsible person(s) to cease the discharge.
5. 
Upon notice provided by New Hanover Township under Subsection 4, the discharger will have a reasonable time, as determined by New Hanover Township, to cease the discharge consistent with the degree of pollution caused by the discharge.
6. 
Nothing in this section shall affect a discharger's responsibilities under state law.

1. 
The following connections are prohibited, except as provided in § 23-801, Subsection 2, above:
A. 
Any drain or conveyance, whether on the surface or subsurface, which allows any nonstormwater discharge including sewage, process wastewater, and wash water to enter the separate storm sewer system and any connections to the storm drain system from indoor drains and sinks.
B. 
Any drain or conveyance connected from a commercial or industrial land use to the separate storm sewer system that has not been documented in plans, maps, or equivalent records and approved by New Hanover Township.

1. 
Roof drains and sump pump drains shall not be connected to streets, sanitary or storm sewers, or roadside ditches in order to promote overland flow and infiltration/percolation of stormwater where advantageous to do so.
2. 
When it is more advantageous to connect directly to streets or storm sewers, connections of roof drains and sump pump drains to streets or roadside ditches may be permitted on a case by case basis as determined by New Hanover Township.
3. 
Roof drains and sump pump drains shall discharge to infiltration areas or vegetative BMPs to the maximum extent practicable.

1. 
No person shall modify, remove, fill, landscape, or alter any existing stormwater BMP or conveyance, unless it is part of an approved maintenance program, without the written approval of New Hanover Township.
2. 
No person shall place any structure, fill, landscaping, or vegetation into a stormwater BMP or conveyance or within an easement that would limit or alter the functioning of the stormwater BMP or conveyance without the written approval of New Hanover Township.
