§ 21-301 Responsibility for Removing Snow and Ice From Sidewalks.

It shall be unlawful for any person, persons, corporations or associations owning, leasing, or in any manner occupying any real estate in the Borough of Shillington to fail to remove or cause to be removed from the public sidewalks on said property, to a width of at least three feet, all snow, ice, hail and sleet within 24 hours after the same shall have ceased to fall or to be formed thereon.

§ 21-302 Effect of Neglect or Refusal to Remove Snow and Ice as Required.

Upon the neglect or refusal of any owner, lessee or possessor of real estate within the Borough of Shillington to comply with the provisions and requirements of this Part, the Borough, by and through the Mayor or any of the police officers, or their designee, of the Borough of Shillington, shall give the owner, lessee or possessor of said real estate four hours' notice to comply with the terms of this Part by either personally serving the owner, lessee or possessor thereof or by posting the property at a conspicuous place thereon and in the event of the neglect of the owner, lessee or possessor of said real estate to remove snow, ice, hail or sleet in accordance with the provisions of this Part after the delivery of notice as aforesaid within the four-hour limitation as provided herein, may cite the owner, lessee or possessor for violation of this Part.

In addition to the aforesaid, the Mayor or police officers, or their designee, of the Borough of Shillington may remove said snow, ice, hail or sleet from the property in question after the four-hour notice aforesaid and the failure of the owner, lessee or possessor to remove said snow, ice, hail or sleet in accordance with the provisions contained herein, and assess the owner, lessee or possessor of said property the cost of said removal, plus 25% additional, together with all costs and expenses incurred incidental thereto.

§ 21-303 Penalties.

Any person who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine not exceeding $1,000 plus costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
