It is hereafter unlawful for any person to throw, place or dispose of, in any street, alley, sidewalk or storm sewer inlet, any excrement, filth, garbage, ashes, refuse, wastepaper, rubbish, empty boxes or containers, dirt, thing or material or any abandoned matter of any kind.

It is hereby unlawful for any person to place on any street, alley, sidewalk or on their private property contiguous thereto any boxes, containers, trash cans or similar devices which contain garbage, ashes, refuse, wastepaper, rubbish or trash for the purpose of municipal trash collection at any time earlier than 4:00 p.m. on the day prior to the municipal trash collection. It is further provided that the said boxes, containers, trash cans or other devices used for the purpose of containing garbage, ashes, refuse, wastepaper, rubbish or trash be removed from the street, alley, sidewalk or private property immediately contiguous thereto within 24 hours after the said municipal trash removal has taken place. It is further provided that all such boxes, containers or other devices used for the containment of such garbage, ashes, refuse, wastepaper, rubbish or trash shall be properly tied or sealed or contain lids thereon securely enclosing the contents thereof.

Any person or entity violating any provision of this chapter shall be subject to the following procedure:
A. 
The municipal official shall issue a written ticket to the owner of the property on which litter has been determined to have accumulated, which ticket shall provide for a penalty in an amount established by resolution of the Borough Council, which penalty may be amended from time to time by the Council. If the penalty is paid within 10 calendar days of its issue, and the condition that warranted the ticket is abated, then the violation is discharged.
B. 
If the person or entity to which the ticket is issued does not pay the applicable penalty or does not abate the condition that warranted the issuance of the ticket as provided for in this chapter, the municipality shall cause a nontraffic citation to be issued for the violation of this chapter. The Borough may also cause the condition to be abated in accordance with other sections of this chapter.
C. 
The nontraffic citation shall be forwarded to and adjudicated by a Magisterial District Judge of the Borough. If found guilty of the violation, the violator shall be sentenced to a fine of no more than $300, plus costs of prosecution and reasonable attorneys' fees.
D. 
Each day that a violation of this chapter continues shall constitute a separate offense. In default of payment of said fine, costs and fees, the violator may be imprisoned in the county jail for a term of not more than 30 days.
