The office of Sewage Enforcement Officer is hereby created, and said officer shall be appointed by the Manor Borough Council to enforce and administer the provisions of the Pennsylvania Sewage Facilities Act, 35 P.S. § 750.1 et seq.; and said Sewage Enforcement Officer shall be compensated as established by resolution of Council and shall serve for a term to be established by resolution of Council.

The said Sewage Enforcement Officer shall be charged with the responsibility of enforcing and administering in the Borough of Manor the provisions of the Pennsylvania Sewage Facilities Act, 35 P.S. § 750.1 et seq., and the rules and regulations of the Commonwealth of Pennsylvania Department of Environmental Protection (formerly known as the Department of Health) promulgated thereunder and as said Act and Rules and Regulations are supplemented and amended periodically.

No work for the construction of an individual sewage disposal system as defined in the Pennsylvania Sewage Facilities Act within the Borough of Manor shall be permitted or begun before the owner of the property on which work is to be done or his agent or contractor has made application to the Borough Sewage Enforcement Officer for a permit, has filed with the Borough Sewage Enforcement Officer plans and specifications for the work to be done, and has been granted a permit authorizing the construction of the individual sewage disposal systems.

The owner or owner's agent shall submit the plans and specifications for such individual sewage disposal system to the Borough Sewage Enforcement Officer and the Borough Sewage Enforcement Officer or his representative shall approve or disapprove such plans and specifications and the individual sewage disposal system and drainage field shall be kept open until the same shall have been inspected and approved by the Borough Sewage Enforcement Officer or his representative.

Any individual sewage disposal system placed in the ground after date of passage of this part shall be made to conform with the requirements hereof and any drainage field made or constructed after the date of passage of this part shall conform to the requirements hereof.

The fee for issuing the above-mentioned permit shall be in an amount as established, from time to time, by resolution of Borough Council.

Any person, firm or corporation who shall violate any provision of this part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs together with reasonable attorney fees and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this part continues or each section of this part which shall be found to have been violated shall constitute a separate offense.
