A.
Any person who violates any provision of this article shall, upon conviction in the Municipal Court of the Borough of Lindenwold, or such other court having jurisdiction, be liable to a fine as listed in § 1-1. Each day that a violation occurs shall be deemed a separate and distinct violation, subject to the penalty provisions of § 1-1. Each separate rental unit that fails to conform to this chapter shall be deemed a separate and distinct violation for each day that the violation occurs within the particular rental unit.
B.
The municipality, in its discretion, may in addition to any other
penalties set forth herein, assess a lien against the subject property
for any failure to comply with this chapter, to include imposition
of a lien for any unpaid fees and late charges assessed against the
owner of the subject property pursuant to this chapter. Any lien assessed
pursuant to this chapter may be enforced and collected in the same
manner as real estate taxes are enforced and collected, with interest
to accrue at the same rate as real estate taxes on all such liens.

In the event any court determines any section or portion of
this chapter to be unenforceable, the remaining sections of this Chapter
shall survive and be enforceable.
