The Town Board of the Town of Alden hereby establishes as its water rates the rates established by the Erie County Water Authority, as they may be amended from time to time.
The Town Board of the Town of Alden hereby establishes as its rules for the sale of water and the collection of rents and charges, the rules established by the Erie County Water Authority, as they may be amended from time to time (the "Water Authority Rules").
All water bills are payable within 15 days following the rendering of the bill.
Any customers whose account has become delinquent for 10 days may be required to provide a deposit as set forth in the Water Authority Rules.
All unpaid water charges in arrears for 30 days or longer shall be subject to a 10% late charge.
Service may be discontinued by the Erie County Water Authority if water charges remain in arrears for 15 days following the rendering of the bill and will not be restored until payment of the unpaid charges, the service restoration charge and a deposit as required by the Water Authority Rules.
All outstanding water charges shall become a lien upon the real property, upon which or in connection with which the water was used.
The Town Clerk, upon receipt of notification from the Water Authority, shall file annually with the Town Board and the Erie County Finance Department or such other appropriate office no later than November 1 in any year a statement showing the unpaid water charges in the respective districts which have not appeared on any such statements previously filed, and said unpaid water charges together with any penalties shall be levied and assessed against the property liable on the annual tax roll of the Town under the name of "water rents."
Such water rates, when collected, shall be applied towards the maintenance, operation, enlargement and improvement of the water system and to pay the Erie County Water Authority the amounts due to them under the Water Authority Rules.
