A. 
All Borough parks and playgrounds within the Borough of Honesdale shall be designated as tobacco-free zones, and the use of any tobacco product or electronic cigarette, as defined herein, in any form shall be prohibited hereafter.
B. 
The tobacco-free zones provided for herein and hereunder are more specifically designated and defined in Exhibit A.[1]

As used in this article, the following terms shall have the meanings indicated:
TOBACCO PRODUCTS
A. 
Any product containing, made, or derived from tobacco or nicotine that is intended for human consumption, whether smoked, heated, chewed, absorbed, dissolved, inhaled, snorted, sniffed, or ingested by any other means, including, but not limited to, cigarettes, cigars, little cigars, chewing tobacco, pipe tobacco, snuff; and
B. 
Any electronic device that delivers nicotine or other substances to the person inhaling from the device, including, but not limited to, an electronic cigarette, cigar, pipe, or hookah.
C. 
Notwithstanding any provision of Subsections A and B to the contrary, "tobacco product" includes any component, part, or accessory of a tobacco product, whether or not sold separately. "Tobacco product" does not include any product that has been approved by the United States Food and Drug Administration for sale as a tobacco cessation product or for other therapeutic purposes where such product is marketed and sold for such and approved purpose.
Appropriate signage shall be conspicuously posted in and at all areas designated as tobacco-free zones.
A. 
Honesdale Borough Council approval of the use of any municipal parks and/or playgrounds shall specifically and prominently indicate the adoption of this article and a prohibition of any tobacco products as defined herein at those venues and forums.
B. 
It shall be the burden and responsibility of any applicant approved for use of any municipal parks and/or playgrounds to specifically and prominently indicate the adoption of this article and the prohibition of any tobacco products as defined herein at those venues and forums.
This article shall be enforced by the Honesdale Borough Police Department.
A. 
Any violation hereunder shall first be addressed by a verbal warning.
B. 
Conviction of any subsequent violation of this article shall result in imposition of a fine in the amount of $25.
