The following terms shall have the meanings indicated:
BOROUGH
Refer to Forty Fort Borough.
HOUSEHOLD
Refer to the individual who applies for a permit and anyone who resides in that individual's residence.
PERMIT
Refer to the form that must be obtained, completed and submitted along with the respective fee to the Code Enforcement office.
YARD SALE
Any public sale of goods on residential property including, but not limited to, garage, home, lawn, sidewalk, or yard.

Four yard sales are permissible per household in one calendar year (January 1 to December 31).
2. 
The maximum duration of any yard sale shall be three consecutive calendar days.
3. 
Permits are required for yard sales.

It shall be unlawful for any individual, group, or corporation to conduct within the Borough a yard sale or permit a yard sale within the Borough on property under the individual, group or corporation's control without first obtaining a yard sale permit from the Borough.

Permits are required for the first four yard sales per calendar year but may be obtained at no charge.
2. 
The fee for the fifth yard sale shall $25.
3. 
The fee for the sixth yard sale shall $50.
4. 
The fee for the seventh and beyond shall be $75 per yard sale.

Any person or household who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine no less than $100 and no greater than $1,000 and prosecution costs. Every day that a violation continues shall constitute a separate offense. After the first violation, the minimum fine shall be increased by $50 for each violation thereafter.

The Code Enforcement is hereby authorized to act on behalf of the Borough and the Police Department may also enforce this Part.
