The purpose of the Business III District is designed as an area for day-care centers on property located on Pennsylvania Avenue bounded on the south by Division Street, bounded on the west by Howard Street, bounded on the north by Pleasant Street and on the east by Pennsylvania Avenue and the former Jehovah Witness property that is now a day-care center on Pitney Street. The district is also designed for alternate uses that would be accommodated in the existing facilities at these locations.
A. 
Permitted uses in the Business III District are as follows:
(1) 
Adult day-care center.
(2) 
School, nursery.
(3) 
Forestry.

A. 
Permitted accessory uses in the Business III District are as follows:
(1) 
Parking.
(2) 
Outside storage.
(3) 
Garage/yard sales subject to the conditions in § 500-77.

A. 
The following special exceptions may be permitted by the Zoning Hearing Board, following review and comment by the Planning Commission, pursuant to standards and criteria as set forth in Article XV, § 500-105D:
(1) 
Accessory uses (customarily related to the below).
(2) 
Adult personal care facility.
(3) 
Animal hospital.
(4) 
Club.
(5) 
Day-care: child day-care center.

Educational institution.
(7) 
Indoor recreational facility.
(8) 
Medical center: special exception.
(9) 
Nursing home.
(10) 
Personal care boarding home/personal health care.
(11)

A. 
The height of the principal building shall not exceed 35 feet.
Unless otherwise specified herein, lot area, lot width and impervious coverage requirements of the following dimensions shall be provided for each structure or use hereafter erected, established or altered for any use permitted within this district.
A. 
All business uses:
(1) 
The minimum lot area shall be 20,000 square feet.
(2) 
The minimum lot width: 100 feet.
(3) 
The maximum coverage of the building and parking area shall be 90%.
(4) 
The minimum building height shall be 35 feet.
(5) 
The maximum land coverage shall be 90%.
The following setback regulations apply to all uses permitted within this district, unless otherwise specified herein.
A. 
Pennsylvania property: Front setbacks shall be east, south and west shall be 15 feet from the edge of the paved cart path, and on the north the setback shall be 15 feet from the residential properties.
(1) 
Fifteen feet from the edge of the paved cart path.
(2) 
Side: 15 feet on each side.
(3) 
Rear: 15 feet from the edge of the paved cart path or adjoining boundary.
B. 
Pitney Street property setbacks shall be as follows:
(1) 
Front: shall be no closer than the average setback of the adjoining residential dwelling.
(2) 
Side: 15 feet on each side.
(3) 
Rear: 15 feet from the adjoining boundary line.
